{"data":{"id":"us-ky/krs-262.906","jurisdiction":"us-ky","citation":"KRS 262.906","heading":"Purchase of Agricultural Conservation Easement (PACE) Corporation --","body":"Board of directors.\n(1) There is hereby created the Purchase of Agricultural Conservation Easement\nCorporation which shall oversee all issues involving purchases of agricultural\nconservation easements. The corporation shall be a de jure municipal corporation\nand political subdivision of the Commonwealth. The corporation shall be a public\nagency within the meaning of KRS 61.805 and 61.870 and shall be attached for\nadministrative purposes to the Department of Agriculture.\n(2) (a) The corporation shall be governed by a board of directors, consisting of the\nfollowing eleven (11) members: four (4) public directors who shall be the\nCommissioner of the Department of Agriculture, the secretary  of the Energy\nand Environment Cabinet, the dean of the University of Kentucky College of\nAgriculture, and the chair of the Soil and Water Conservation Commission, or\ntheir designees; and seven (7) private directors who shall be appointed by the\nGovernor, as follows:\n1. One (1) private director from each of the six (6) congressional districts;\nand\n2. One (1) private director from a list of three (3) persons suggested by the\nKentucky Farm Bureau Federation, Inc.\n(b) Initial appointment of the private directo rs by the Governor shall be for\nstaggered terms.\n(c) No more than four (4) of the private directors shall be from the same political\nparty. Members shall serve a term of four (4) years, with the exception of the\ninitial members, and may be reappointed. Vacancies shall be filled in the same\nmanner as the appointment is made.\n(3) (a) Any member who has an ownership interest in any of the lands eligible for the\npurchase of an agricultural conservation easement or other property interest\nand who wishes to apply  to sell an easement while serving on the board of\ndirectors shall withdraw himself from all board activities prior to application\nand until the transaction is complete. The Governor shall appoint an interim\nmember to fill the vacancy until the transaction is complete.\n(b) Any person who has previously applied for or sold an agricultural\nconservation easement may serve on the board.\n(4) Members shall not be compensated for their services but shall be reimbursed for\nexpenses incurred in the performance of their duties.","path":["KRS Chapter 262"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=12816","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:53:12Z","sha256":"90cc817983911a7ee3da07596c54a474252eeb86cb52602e54c042e8c56cbd6c","source_id":"us-ky","stale":false,"prev":"us-ky/krs-262.904","next":"us-ky/krs-262.908"},"notice":"GroundRules: Original legal text.
