{"data":{"id":"us-ky/krs-267.320","jurisdiction":"us-ky","citation":"KRS 267.320","heading":"Bonds authorized when average assessment exceeds twenty -five cents","body":"($0.25) per acre -- Failure to pay assessment is consent to bonds.\n(1) If the total assessment exceeds the average of twenty -five cents ($0.25) per acre on\nall the land assessed, the b oard may give notice by publication pursuant to KRS\nChapter 424, and by posting a notice at the door of the courthouse in each county in\nwhich land assessed is located, and at five (5) conspicuous places in the district, that\nit proposes to issue bonds for  the construction of the improvement, giving the\namount of bonds to be issued, the rate of interest they are to bear and the time when\npayable. Any landowner having land assessed in the district and not wanting to pay\ninterest on the bonds may, within thirty (30) days after the publication of the notice,\npay the county treasurer the full amount of his assessment and have his land\nreleased. If the landowner produces a treasurer's receipt showing such payment, the\ncounty clerk or the secretary of the board sh all indorse the release upon the\nassessment roll, and report to the board all releases made by him. This report shall\nbe recorded on the record or minutes of the board. When the board is satisfied that\nany assessment has been paid it may order a release made.\n(2) Each person owning land assessed in the district who fails to pay the full amount of\nhis assessment within thirty (30) days after publication of the notice shall be\ndeemed to consent to the issuing of bonds, and in consideration of the right to pay\nhis assessment in installments he thereby waives his right to any defense against the\ncollection of the assessment because of any irregularity, illegality or defect in the\nproceeding prior to that time, except in the case of an appeal, which is not affect ed\nby this waiver.","path":["KRS Chapter 267"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=12896","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:53:13Z","sha256":"5046405f8f2f60cd0ff96a1eff66f5f8601bc3bd6564e054418742d1e3429a90","source_id":"us-ky","stale":false,"prev":"us-ky/krs-267.310","next":"us-ky/krs-267.330"},"notice":"GroundRules: Original legal text.
