{"data":{"id":"us-ky/krs-267.350","jurisdiction":"us-ky","citation":"KRS 267.350","heading":"Board or court may change assessment -- Relevy.","body":"(1) When the county judge/executive has confirmed an assessment for any\nimprovement and it has been modified by a court of superior jurisdiction, or for\nsome unforeseen cause it cannot be collected, the board may change the original\nassessment to conform to th e judgment of the court and to cover any deficit caused\nby the order of the county judge/executive, or unforeseen occurrence.\n(2) In any other case where, for any cause, it is ascertained that the amount assessed\nagainst the property in the district is not  sufficient to complete the improvement\nprovided for, and a petition is filed by the board, or any three (3) or more of the\noriginal petitioners, or by the board and three (3) or more of the petitioners, stating\nthe amount of the deficit, the causes thereo f and the amount necessary to be raised\nin order to complete the work, and asking an additional assessment and levy, the\ncounty judge/executive shall cause the county clerk to give notice of the filing and\npurpose of the petition, and shall fix a time betw een ten (10) and twenty (20) days\nfrom the giving of the notice when the petition will be acted upon, and exceptions,\nanswers or objections received. The notice shall be published pursuant to KRS\nChapter 424, and posted in at least three (3) public places in the district. Such\npublication shall be sufficient notice of the proceeding to all parties affected. Upon\nhearing, if the county judge/executive finds that the additional assessment and levy\nasked for in the petition are necessary and ought to be made in order to complete the\nwork, he shall direct such assessment and relevy to be made by the board.\n(3) Any additional assessment and relevy made under this section shall be made in the\nsame ratio on the land benefited as the original assessment, and shall b e collected in\nthe same way.","path":["KRS Chapter 267"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=12899","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:53:13Z","sha256":"c7cf60ff6fb016ed046fb1dcdd38e2502718caea4ad0540af519dd1fc6dfbf02","source_id":"us-ky","stale":false,"prev":"us-ky/krs-267.340","next":"us-ky/krs-267.360"},"notice":"GroundRules: Original legal text.
