{"data":{"id":"us-ky/krs-267.420","jurisdiction":"us-ky","citation":"KRS 267.420","heading":"Fees -- Costs -- Expenses -- Compensation of employees and viewers.","body":"(1) The fees of officers for services rendered under this chapter shall be the same as\nfees allowed by law for similar services in other cases. Such fees shall be taxed as\npart of the costs. The county judge/executive shall also include as costs reasonable\nfees to the attorneys for the petitioners in the proceeding to establish the\nimprovement. All costs shall be paid on the order of the county judge/executive out\nof the drainage fund. The compensation allowed for services of the engineers,\nviewers and for all other labor, unless paid out of funds deposited by the petitioners,\nshall be paid on the order of the county judge/executive out of the drainage fund. If\nany part of such expense has been paid by the petitioners, or any deposit for that\npurpose has been ma de by them, it shall be refunded to them, without interest, out\nof the drainage fund. If the improvement is not established, all such costs and\nexpenses shall be paid by the petitioners, and they shall be liable for the same on\ntheir bond.\n(2) If any perso n, including any engineer or viewer, who has performed labor in\nconnection with the improvement up to the time of final reference to the board,\ndesires payment of the amount due up to that time, he may so inform the county\njudge/executive, which shall ther eupon notify the petitioners or their attorneys of\nrecord of such fact in writing, stating the amount required, and call upon the\npetitioners to deposit with the county treasurer an amount sufficient to pay the\nsame. The petitioners shall then deposit that amount within thirty (30) days from the\ndate of receiving the notice. If they fail to pay it within that time, the proceeding\nmay be dismissed at the cost of the petitioners. The treasurer shall pay out the\nmoney so deposited with him upon order or warran t of the board, if then appointed,\nand if not, on order of the county judge/executive.\n(3) The compensation of the engineer on the board of viewers shall be fixed by the\ncounty judge/executive at or before the time of his appointment, by order entered of\nrecord. The other viewers shall receive four dollars ($4) per day for the time\nactually engaged in performing their duties. Rodmen, chain carriers and other\nlaborers employed in the work shall receive not exceeding two dollars ($2) per day\nfor their services. Any fees or compensation not provided for in this chapter shall be\nfixed by the county judge/executive unless the person providing the services is\nemployed by the board, in which case the board shall fix his fees or compensation.\nThe treasurer shall onl y pay out money on order of the county judge/executive, or\non warrants drawn by the board, signed by its president and countersigned by its\nsecretary.","path":["KRS Chapter 267"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=12906","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:53:13Z","sha256":"f8460072b2a096316e9753999eb78cd328824644b62e3d6689dde76c71036711","source_id":"us-ky","stale":false,"prev":"us-ky/krs-267.410","next":"us-ky/krs-267.430"},"notice":"GroundRules: Original legal text.
