{"data":{"id":"us-ky/krs-268.580","jurisdiction":"us-ky","citation":"KRS 268.580","heading":"Owner to pay for damage to improvement caused by him -- No person to","body":"obstruct improvement.\n(1) If repairs to any improvement become necessary by reason of the act or negligence\nof any owner or his servant, agent, or stock, by which the improvement is\nobstructed, any repairs necessary to restore it to its previous condition shall be made\nby the owner at his own expense. Upon his failure to make the repairs within thirty\n(30) days after being notified by the board, he shall be deemed guilty of a\nmisdemeanor.\n(2) The board may have the obstruction removed, paying the cost out of funds collected\nfrom any district for which it is an outlet or of which it is a part, and if there is more\nthan one the expense shall be prorated between them. All amounts so paid with\ninterest at the rate of six percent (6%) per annum shall be charged to the owner in\nfault, and may be recovered by the board in any court of competent jurisdiction, and\nshall constitute a lien upon the land of such owner. When any such amount is\nrecovered it shall be returned to the fund from which it was paid.\n(3) No person shall damage or in any way obstruct any drain, levee or other\nimprovement, or place any flood gate, bridge or fence across it without consent of\nthe board, by order entered upon it s record, in which shall be specified the kind of\nflood gate, bridge or fence, and it shall be erected in accordance with the order.\n(4) The board shall enforce the provisions of this section.","path":["KRS Chapter 268"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=12982","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:53:14Z","sha256":"8921810e7c7e7cb9310b0153d07374fdc0bfd5c4a60c6d8792f54d3f31ff0f88","source_id":"us-ky","stale":false,"prev":"us-ky/krs-268.570","next":"us-ky/krs-268.590"},"notice":"GroundRules: Original legal text.
