{"data":{"id":"us-ky/krs-269.270","jurisdiction":"us-ky","citation":"KRS 269.270","heading":"County surface water drainage districts.","body":"(1) The county judge/executive in each county of this Commonwealth, wherein the\nfiscal court has requested it, is hereby authorized to establish a countywide surface\nwater drainage district for the entire county including all municipalities. The cost of\nprocuring the necessary rights-of-way and the construction and maintenance of such\ncountywide drainage district shall be paid by the fiscal court out of the annual levy\nfor county taxes. When the fiscal court undertakes such a project it may acquire for\nthe county by contract or condemnation any land necessary to carry out the project.\nIf condemnation proceedings are necessary they shall be conducted in the manner\nprovided in the Eminent Domain Act of Kentucky.\n(2) The administration of this district shall be exc lusively by or within the fiscal court\nof said county, and the fiscal court is hereby authorized and empowered to employ\nsuch assistants, including commissioners or superintendent, and other employees as\nmay be necessary for the construction, maintenance and continued operation of said\nsystem, and shall fix the salaries of all employees to be paid as other county\nemployees are paid.\n(3) In the construction and maintenance of such drainage system the fiscal court is\nauthorized and empowered, as a part of the  cost of construction and maintenance of\nsaid system, to build or construct such bridges and culverts over and across the\nditches or canals of this system as in the opinion of the fiscal court are necessary.\n(4) Nothing herein contained shall authorize or empower the construction or\nmaintenance of a sanitary sewer system or sanitary sewers.","path":["KRS Chapter 269"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=13017","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:53:14Z","sha256":"b23a65e00a034f1caa0fe8de2133c2237e5d962a45a3acb669e2db28bf8ecd9c","source_id":"us-ky","stale":false,"prev":"us-ky/krs-269.260","next":"us-ky/krs-26a.010"},"notice":"GroundRules: Original legal text.
