{"data":{"id":"us-ky/krs-26a.012","jurisdiction":"us-ky","citation":"KRS 26A.012","heading":"Persons with disabilities or members of their families to be included in","body":"membership of boards and committees affecting them -- Prohibition against\ndiscrimination.\n(1) To ensure opportunities for participation by persons with disabilities and their\nfamilies in the development of policies, support, and services that affect them:\n(a) Persons with one (1) or more disabilities, or members of their families, who\nmay be affected by or be the subject of an advisory board, committee,\ncommission, task force, or ad hoc committee, shall be included in the\nmembership of each advisory board, committee, commission, task force, or ad\nhoc committee of the judicial branch.\n(b) Persons with one (1) or more disabilities, or members of their families, shall\nbe included in t he membership of any advisory committee, board, or\ncommission of the judicial branch whose mission or purpose is to make\nrecommendations or to establish criteria for services and support for persons\nwith disabilities or to develop standards that govern the  services and support\nfunded or administered by any state government agency.\n(c) Persons with one (1) or more disabilities shall not be discriminated against\nand shall be given an equal opportunity to be included in the membership of\nany other advisory boa rd, committee, commission, task force, or ad hoc\ncommittee consistent with and to the extent required by the Federal\nAmericans with Disabilities Act.\n(2) As used in this section \"disability\" has the same meaning as in KRS 12.450.\n(3) The requirements of th is section shall affect all boards, committees, commissions,\ntask forces, or ad hoc committees created on or after June 21, 2001.\n(4) For boards, committees, commissions, task forces, or ad hoc committees in\nexistence prior to June 21, 2001, any vacancy ar ising on or after June 21, 2001,\nshall be filled pursuant to this section.\n(5) The requirements of this section shall only apply to an advisory board, committee,\ncommission, task force, or ad hoc committee that is created specifically to develop\nor oversee policies or programs related to persons living with a disability or their\nfamilies, except that the provisions of paragraph (c) of subsection (1) of this section\nshall apply.","path":["KRS Chapter 26A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=20881","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:48:46Z","sha256":"190dec086d05ead0771c2fc790b16c3502ccab6af25581e4094dc85886bad88e","source_id":"us-ky","stale":false,"prev":"us-ky/krs-26a.010","next":"us-ky/krs-26a.013"},"notice":"GroundRules: Original legal text.
