{"data":{"id":"us-ky/krs-26a.300","jurisdiction":"us-ky","citation":"KRS 26A.300","heading":"Collection of judgment -- Damages.","body":"(1) When collection of a judgment for the payment of money has been stayed as\nprovided in the Rules of Civil Procedure, there shall be no damages assessed on the\nfirst appeal as a matter of right contemplated by Section 115 of the Constitution of\nKentucky.\n(2) When collection of a judgment for the payment of money has been stayed as\nprovided in the Rules of Civil Procedure pending any other appeal, damages of ten\npercent (10%) on the amount stayed shall be imposed against the appellant in the\nevent the judgment  is affirmed or the appeal is dismissed after having been\ndocketed in an appellate court.\n(3) Similar damages of ten percent (10%) shall be imposed when a petition for writ of\ncertiorari, petition for rehearing, or other petition which stays collection of a\njudgment for the payment of money is denied by an appellate court under\ncircumstances not constituting a first appeal under subsection (1) of this section.\n(4) No additional penalty shall be imposed upon a party as a consequence of a review\nsubsequent to a petition or a second appeal.\n(5) Damages imposed under subsection (2) or (3) of this section shall not be payable\nand shall be void if the decision of the trial court awarding the payment of money is\nultimately reversed.","path":["KRS Chapter 26A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=20907","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:48:46Z","sha256":"c11d17b3abe60038923779099f37423ea8e3d6ee07d87f23d2e72c7124aff883","source_id":"us-ky","stale":false,"prev":"us-ky/krs-26a.260","next":"us-ky/krs-26a.400"},"notice":"GroundRules: Original legal text.
