{"data":{"id":"us-ky/krs-271b.13-310","jurisdiction":"us-ky","citation":"KRS 271B.13-310","heading":"Court costs and counsel fees.","body":"(1) The court in an appraisal proceeding commenced under KRS 271B.13 -300 shall\ndetermine all costs of the proceeding, including the reasonable compensation and\nexpenses of appraisers appointed by the court. The court shall assess the costs\nagainst the corporation, except that the court may assess costs against all or some of\nthe dissenters, in amounts the court finds equitable, to the extent the court finds the\ndissenters acted arbitrarily, vexatiously, or not in good faith in demanding payment\nunder KRS 271B.13-280.\n(2) The court may also assess the fees and expenses of counsel and experts for the\nrespective parties, in amounts the court finds equitable:\n(a) Against the corporation and in favor of any or all dissenters, if the court finds\nthe corporation did no t substantially comply with the requirements of KRS\n271B.13-200 to 271B.13-280; or\n(b) Against either the corporation or a dissenter, in favor of any other party, if the\ncourt finds that the party against whom the fees and expenses are assessed\nacted arbit rarily, vexatiously, or not in good faith with respect to the rights\nprovided by this subtitle.\n(3) If the court finds that the services of counsel for any dissenter were of substantial\nbenefit to other dissenters similarly situated, and that the fees for those services\nshould not be assessed against the corporation, the court may award to these counsel\nreasonable fees to be paid out of the amounts awarded the dissenters who were\nbenefited.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=13446","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:53:19Z","sha256":"3abda2ddf49e11c8414e44b171dc84c83599750c1eddd0bd2d56d50cf070956e","source_id":"us-ky","stale":false,"prev":"us-ky/krs-271b.13-300","next":"us-ky/krs-271b.14-010"},"notice":"GroundRules: Original legal text.
