{"data":{"id":"us-ky/krs-272a.13-050","jurisdiction":"us-ky","citation":"KRS 272A.13-050","heading":"Proceeds and expenses.","body":"(1) Except as otherwise provided in subsection (2) of this section:\n(a) Any proceeds or other benefits of a derivative action to enforce a right of a\nlimited cooperative association, whether by judgment, compromise, or\nsettlement, belong to the association and not to the plaintiff; and\n(b) If the plaintiff in the derivative action receives any proceeds, the plaintiff shall\nimmediately remit them to the association.\n(2) On termination of the proceeding, the court may:\n(a) Require the plaintiff to pay any defenda nt's reasonable expenses, including\ncounsel fees, incurred in defending the proceeding to the extent it finds that\nthe proceeding or any portion thereof was commenced without reasonable\ncause or for an improper purpose; and\n(b) Require the association to p ay the plaintiff's reasonable expenses, including\ncounsel fees, incurred in the proceeding if it finds that the proceeding has\nresulted in a substantial benefit to the association.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=41079","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:53:23Z","sha256":"c080054c16fda7d389cdddf853eb78c19e118e2f540cbb9d1d7a235dc9dd10fd","source_id":"us-ky","stale":false,"prev":"us-ky/krs-272a.13-040","next":"us-ky/krs-272a.14-010"},"notice":"GroundRules: Original legal text.
