{"data":{"id":"us-ky/krs-272a.7-040","jurisdiction":"us-ky","citation":"KRS 272A.7-040","heading":"Remedies for breach of marketing contract.","body":"(1) Damages to be paid to a limited cooperative association for breach or anticipatory\nrepudiation of a marketing contract may be liquidated, but only at an amount or\nunder a formula that is reasonable in light of the actual or anticipated harm caused\nby the breach or repudiation assessed as of the time of the making of the marketing\ncontract. A provision that so provides is not a penalty or otherwise unreasonable.\n(2) Upon a breach of a marketing contract, whether by anticipatory repudiation or\notherwise, a limited cooperative association may seek:\n(a) An injunction to prevent further breach; and\n(b) Specific performance.\n(3) The remedies in this section are in addition to any other remedies available to an\nassociation under law other than this chapter.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=41029","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:53:22Z","sha256":"36674b29b89f857d629853ffe89b3e95333093df155b242ef61765d473ab693c","source_id":"us-ky","stale":false,"prev":"us-ky/krs-272a.7-030","next":"us-ky/krs-272a.8-010"},"notice":"GroundRules: Original legal text.
