{"data":{"id":"us-ky/krs-273.435","jurisdiction":"us-ky","citation":"KRS 273.435","heading":"Designation of community action agency.","body":"(1) A community action agency may be designated by the following political\nsubdivisions:\n(a) One (1) or more counties;\n(b) One (1) or more municipal corporations; or\n(c) One (1) or more counties and one (1) or more municipal corporations.\n(2) The chief elected official of the designating political subdivision may designate:\n(a) The political subdivision as the community action agency, with the\nconcurrence of the legislative authority of the political subdivision; or\n(b) An eligible private nonprofit corporation  as a community action agency if\nsuch corporation's board of directors is established pursuant to KRS 273.437.\n(3) In the event a political subdivision elects not to designate a community action\nagency as provided under this section, the Governor may desig nate an eligible\nprivate nonprofit corporation as the community action agency for the political\nsubdivision; provided, however, that the board of directors for the community\naction agency shall be established pursuant to KRS 273.437.\n(4) The designating political subdivision shall:\n(a) Publish, pursuant to KRS Chapter 424, a notice containing the designation of\na community action agency, a summary of the plan for such agency, a location\nat which the plan can be reviewed, and the time, date, and location of a\nhearing on the plan; and\n(b) Not less than thirty (30) nor more than sixty (60) days from the publication of\nthe notice in subsection (1), convene a public hearing specifically for the\npurpose of receiving public comment on the designation plan.\n(5) All community action agencies which were organized and operating subject to the\nprovisions of KRS 273.410 to 273.455 as of September 30, 1981, shall be\nrecognized as the community action agencies for each applicable political\nsubdivision unless and until each political subdivision exercises the authority\ngranted under this section.\n(6) No community action agency shall be created after July 15, 1982, unless the:\n(a) Population of the political subdivision equals or exceeds fifty thousand\n(50,000); or\n(b) Political subdivisions designating a new community action agency are\ngeographically contiguous and include a combined population equal to or\nexceeding fifty thousand (50,000).","path":["KRS Chapter 273"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=13739","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:53:25Z","sha256":"193f8297cbab8be7bc3f6a9603b2e0a8dd7095d26ddb22cf9f8dc00a10c71129","source_id":"us-ky","stale":false,"prev":"us-ky/krs-273.430","next":"us-ky/krs-273.437"},"notice":"GroundRules: Original legal text.
