{"data":{"id":"us-ky/krs-273.437","jurisdiction":"us-ky","citation":"KRS 273.437","heading":"Administering boards.","body":"(1) When a private nonprofit corporation is designated as a community action agency,\nthe board of directors of the private nonprofit corporation, if constituted in\ncompliance with subsection (3) of this section, shall be the governing board.\n(2) When a politi cal subdivision is designated as the community action agency the\nboard of directors of the community action agency shall be a community action\nboard constituted as required by subsection (3) of this section.\n(3) Governing boards and community action board s shall be so established and\norganized that the poor and residents of the area concerned will be able to influence\nthe character of programs affecting their interests and regularly participate in the\nplanning and implementation of those programs. The arti cles of incorporation shall\nbe deemed to meet these requirements if they provide that:\n(a) One-third (1/3) of the members of the administering board shall be public\nofficers, including elected public officials or their representatives, unless the\nnumber of public officers reasonably available or willing to serve is less than\none-third (1/3) of the membership of the board;\n(b) At least one -third (1/3) of the members of the administering board shall be\npersons chosen in accordance with democratic selection procedures adequate\nto assure that they are representative of the poor in the area to be served by the\nagency;\n(c) The remaining members of the administering board shall be officials or\nmembers of business, industry, labor, religious, welfare, education, or other\nmajor groups and shall be interested in the community;\n(d) Each member of the board who is to represent a specific geographic area\nwithin a community shall reside in the area he represents; and\n(e) Total membership of the board is not less than fifteen (15) and not more than\nfifty-one (51).\n(4) Neighborhood based organizations composed of residents of the area or individual\nmembers of the groups served by the community action agency shall be consulted\nby each community action agency to assist the agency in the planning, conduct, and\nevaluation of components of the community action program.","path":["KRS Chapter 273"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=13740","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:53:25Z","sha256":"fcd9374363053f35eb6040679cc551514c088c1c5cad11773d44915b83cd0288","source_id":"us-ky","stale":false,"prev":"us-ky/krs-273.435","next":"us-ky/krs-273.439"},"notice":"GroundRules: Original legal text.
