{"data":{"id":"us-ky/krs-273.439","jurisdiction":"us-ky","citation":"KRS 273.439","heading":"Powers of administering boards.","body":"(1) The governing board of a private, nonprofit community action agency shall have the\nsame legal powers and responsibilities granted under its state charter as the board of\ndirectors of any private, nonprofit corporation incorporated in the Commonwealth\nof Kentucky including the power to enter into legally binding agreements with any\nfederal, state, or local agency, or with any private funding organization for the\npurpose of administering programs or providing services.\n(2) In addition to these general corpora te powers which all private, nonprofit\ncorporations possess, the following are specific powers which a governing board of\na private nonprofit community action agency shall possess:\n(a) To appoint the executive director of the community action agency;\n(b) To determine major personnel, organization, fiscal, and program policies;\n(c) To determine overall program plans and priorities for the community action\nagency, including provisions for evaluating progress against performance;\n(d) To make final approval of all program proposals and budgets;\n(e) To enforce compliance with all conditions of all grants contracts;\n(f) To oversee the extent and the quality of the participation of the poor in the\nprograms of the community action agency;\n(g) To determine rules and procedures for the governing board; and\n(h) To select the officers and the executive committee, if any, of the governing\nboard.\n(3) When a political subdivision is designated as the community action agency the\ndesignating officials possess those powers con tained in subsection (2)(b) through\n(e) of this section and share with the community action board the power contained\nin subsection (2)(a) of this section. The designating officials may delegate the\npowers contained in subsection (2)(b) through (d) only to  the community action\nboard.\n(4) When a political subdivision is designated as the community action agency, it shall\nadminister its program through the community action board. The community action\nboard shall have the following powers:\n(a) To participate j ointly and to concur formally in the selection of the executive\ndirector of the community action agency;\n(b) To exercise all powers which the designating officials choose to delegate to\nthe community action board;\n(c) To oversee the extent and the quality of the participation of the poor in the\nprograms of the community action agency;\n(d) To determine rules and procedures for the community action board; and\n(e) To select the officers and the executive committee, if any,  of the community\naction board.\n(5) When a political subdivision is designated as the community action agency, the\ncommunity action board shall deliberate upon the following matters and submit its\nwritten recommendations to the designating officials before the designating officials\nrender a final decision unless the designating officials have specifically delegated\nthese powers:\n(a) Determination of major personnel, organization, fiscal, and program policies;\n(b) Determination of overall program plans and priorities;\n(c) Approval of all program proposals and budgets;\n(d) Approval of all evaluation and assessment studies and reports; and\n(e) Approval of all arrangements for delegating the planning, conducting, or\nevaluating a component of the work program.","path":["KRS Chapter 273"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=13741","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:53:25Z","sha256":"9b84ab10ee50fd360faf511539ad7fbcbdc29a274899a7e6487c7373517975f1","source_id":"us-ky","stale":false,"prev":"us-ky/krs-273.437","next":"us-ky/krs-273.440"},"notice":"GroundRules: Original legal text.
