{"data":{"id":"us-ky/krs-273a.020","jurisdiction":"us-ky","citation":"KRS 273A.020","heading":"Statement of authority as to real property.","body":"(1) An interest in real property held in the name of an unincorporated nonprofit\nassociation may be transferred by a person authorized to do so in a statement of\nauthority recorded by the association in the office in the county in which a transfer\nof the property would be recorded.\n(2) A statement of authority shall set forth:\n(a) The name of the unincorporated nonprofit association;\n(b) The address in this Commonwealth, including the street address, if any, of the\nassociation or, if the association does not ha ve an address in this\nCommonwealth, its out-of-state address;\n(c) That the association is an unincorporated nonprofit association;\n(d) The name and title or position of a person authorized to transfer an interest in\nreal property held in the name of the association; and\n(e) An affirmation by the person executing the statement that they are duly\nauthorized to do so.\n(3) A statement of authority shall be executed by a person other than the person\nauthorized in the statement to transfer the interest.\n(4) A fil ing officer may collect a fee for recording a statement of authority in the\namount of ten dollars ($10).\n(5) A document amending, revoking, or canceling a statement of authority or stating\nthat the statement is unauthorized or erroneous shall meet the requ irements for\nexecuting and recording an original statement.\n(6) Unless canceled earlier, a recorded statement of authority and its most recent\namendment expire five (5) years after the date of the most recent recording.\n(7) If the record title to real prop erty is in the name of an unincorporated nonprofit\nassociation and the statement of authority is recorded in the office of the county in\nwhich a transfer of the property would be recorded, the authority of the person\nnamed in the statement to transfer is conclusive in favor of a person that gives value\nwithout notice that the person lacks authority.","path":["KRS Chapter 273A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=44328","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:53:25Z","sha256":"41506a7a4296d4a4e24c3735e73902eb6e6ae3e750b8623f87c37ce8f0f5fac4","source_id":"us-ky","stale":false,"prev":"us-ky/krs-273a.015","next":"us-ky/krs-273a.025"},"notice":"GroundRules: Original legal text.
