{"data":{"id":"us-ky/krs-277.315","jurisdiction":"us-ky","citation":"KRS 277.315","heading":"Liability insurance requirement for special passenger excursion trains --","body":"Limitation of damages.\n(1) As used in this section:\n(a) \"Nonprofit sponsor\" means a corporation whose purpose includes the historic\npreservation of documents, memorabilia, and e quipment associated with the\nrailroad industry, and public education regarding the history, current\nfunctions, and future of railroad transportation and which is exclusive to\nreligious, scientific, literary, or educational within the meaning of 26 U.S.C.\nsec. 501(c)(3) as amended; and\n(b) \"Special passenger excursion train\" means a train offered by a nonprofit\nsponsor to the public for operation over a common carrier railroad or railroad\nauthority.\n(2) Notwithstanding any other statute to the contrary, liab ility for all claims, whether\nfor compensatory damages or punitive damages arising from a rail incident or\naccident occurring in the Commonwealth, and made against a nonprofit sponsor of\na special passenger excursion train or owner or operator of an excurs ion train or\nagainst the railroad or rail authority over whose tracks the special passenger\nexcursion train was operated when the accident or incident occurred, shall not\nexceed the valid and collectible liability insurance coverage maintained on the\nspecial passenger excursion train. The sponsor of a special passenger excursion\ntrain shall maintain or provide evidence of insurance coverage of not less than five\nmillion dollars ($5,000,000) per occurrence or per claim.
