{"data":{"id":"us-ky/krs-278.015","jurisdiction":"us-ky","citation":"KRS 278.015","heading":"Water district; combined water, gas, or sewer district; or water","body":"commission a public utility subject to Public Service Commission --\nExceptions.\nNotwithstanding any of the provisions of KRS Chapter 74, any water district; combined\nwater, gas, or sewer  district; or water commission, except a joint commission created\nunder the provisions of KRS 74.420 to 74.520, shall be a public utility and shall be\nsubject to the jurisdiction of the Public Service Commission in the same manner and to\nthe same extent as any other utility as defined in KRS 278.010, except:\n(1) As provided in KRS 278.023; or\n(2) When a wholesale supplier selling water or providing sewage treatment to a water\ndistrict; combined water, gas, or sewer district; or water commission increases it s\nrates, the water district or combined water, gas, or sewer district shall have the\nauthority to increase its rates commensurate with the wholesale supplier without\nprior approval by the commission.\nWithin twenty (20) days after any such increase in rates , the district shall file its revised\ntariffs with the commission, together with a copy of the notice from its wholesale supplier\nshowing the increase in the rate charged to the utility, and a statement of the volume of\npurchased water used or sewage treated to calculate the increase in rates. The commission\nshall approve the filing or establish revised rates by order no later than thirty (30) days\nafter the above documents are filed with it.
