{"data":{"id":"us-ky/krs-278.0154","jurisdiction":"us-ky","citation":"KRS 278.0154","heading":"Water district or water association may assess customer a late payment","body":"charge of 10% of amount billed -- How charge assessed and applied --\nCommission without power to affect late payment charge -- Waiver of late\npayment charge.\n(1) Any water district or water association formed for the purpose of furnishing water\nor sewer services to the general public for compensation pursuant to KRS Chapter\n74 or 273 may assess a customer who fails to pay a bill for rendered services by the\ndue date shown on the bill a late payment charge of ten percent (10%) of the amount\nbilled.\n(2) A late payment charge or fee shall not be assessed more than once per billing cycle\nor on any part of the late payment charge.\n(3) Any payment received by a water district or water association shall first be applied\nto the portion of the bill for service rendered.\n(4) The commission shall not modify, reject, discontinue, abolish, or suspend the\noperation of a late payment charge that is provided for currently, or has been\nprovided for in the past, in a water district or water association tariff.\n(5) A water district or water association shall not be required to demonstrate to the\ncommission that the late payment charge is required to recover customer -specific\ncosts incurred that  would otherwise result in a monetary loss to the utility or\nincreased rates to other customers to whom no benefits accrue from the service\nprovided or actions taken.\n(6) Any late payment charge imposed by a water district or water association shall be\nwaived for any bill or portion of a bill for which a customer has received third -party\nbilling assistance through the Low -Income Household Drinking Water and\nWastewater Emergency Assistance Program or from another public or charitable\nsource.","path":["KRS Chapter 278"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=51387","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:53:29Z","sha256":"6ae96531f3f242b07f6ea2fa0f8ce1910e9e1712cdffe78c6a22ae6974287c0e","source_id":"us-ky","stale":false,"prev":"us-ky/krs-278.0152","next":"us-ky/krs-278.016"},"notice":"GroundRules: Original legal text.
