{"data":{"id":"us-ky/krs-278.038","jurisdiction":"us-ky","citation":"KRS 278.038","heading":"Public Service Commission -- Appointments -- Membership -- Vacancies --","body":"Limitations.\n(1) The Public Service Commission shall consist of five (5) members appointed by the\nGovernor as follows:\n(a) Two (2) shall be licensed attorneys who have active ly practiced law in the\nCommonwealth for at least seven (7) years; and\n(b) Three (3) shall have education or training, and five (5) years of actual\nexperience, in one (1) or more of the following fields:\n1. Economics;\n2. Engineering;\n3. Accounting;\n4. Finance;\n5. Utility regulation, operation, or management;\n6. Pipeline or utility infrastructure safety;\n7. Business management; or\n8. Environmental management.\n(2) Appointments and re appointments to the commission shall be subject to\nconfirmation by the Senate as provided in KRS 11.160.\n(3) (a) Every four (4) years, the commissioners shall elect a chair from among the\ncommissioners, who shall serve a four (4) year term or until his or her term\nexpires without reappointment, whichever comes first.\n(b) Members of the commission may serve multiple terms as chair subject to the\nterm limitations set forth in subsection (5) of this section.\n(c) The chair shall be the chief executive officer o f the commission and shall\ndesignate one (1) of the commissioners to serve as vice chair to act for the\nchair in his or her absence.\n(d) The chair may designate in writing one (1) or more commissioners or the\nexecutive director to act for him or her in the  event of his or her absence or\ninability for any reason to discharge the duties of the position. The designee of\nthe chair shall have all of the duties and powers of the chair for the duration of\nthe designation, except that the executive director shall n ot serve as a member\nof the commission on any cases before the commission.\n(4) Vacancies for unexpired terms shall be filled in the same manner as the original\nappointments, but the appointee shall hold office only until the end of the unexpired\nterm and shall be subject to confirmation by the Senate as provided in KRS 11.160.\n(5) Members of the commission shall serve no more than three (3) terms, but any terms\nor partial terms served prior to April 15, 2026, shall not be counted toward the term\nlimits established by this subsection.\n(6) After the initial appointments, a member of the commission shall serve for a term of\nfour (4) years and until a successor is appointed and qualified.\n(7) No more than three (3) members of the commission shall be of the same  political\nparty, and members of the commission shall not serve on any other regulatory\nbodies during their terms on the commission.","path":["KRS Chapter 278"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=57092","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:53:29Z","sha256":"827a00db58e20b7ac200d0c303d9fe0a2bdd67e39defa765e11d0b00b57efa37","source_id":"us-ky","stale":false,"prev":"us-ky/krs-278.035","next":"us-ky/krs-278.040"},"notice":"GroundRules: Original legal text.
