{"data":{"id":"us-ky/krs-278.277","jurisdiction":"us-ky","citation":"KRS 278.277","heading":"Fuel adjustment cost recovery extension -- Any coal severance taxes","body":"imposed a factor in any fuel adjustment clause review.\n(1) In the administration of an electric utility's fuel adjustment clause and any\nassociated tariffs, the commission ma y, upon the request of an electric utility,\nextend the period for recovery of fuel adjustment costs that are typically\nrecoverable in order to reduce volatility for consumers and encourage stability in\nrates.\n(2) In any review by the commission of any fuel  adjustment clause, for any contracts\nentered into on or after July 1, 2021, the commission shall, in determining the\nreasonableness of fuel costs in procurement contracts and fuel procurement\npractices, evaluate the reasonableness of fuel costs in contrac ts and competing bids\nbased on the cost of the fuel less any coal severance tax imposed by any\njurisdiction.\n(3) As used in this section, \"fuel adjustment clause\" means any clause or provision in\nany tariff or contract by which an electric utility may immediately recover increases\nin fuel costs subject to later scrutiny or review by the commission.","path":["KRS Chapter 278"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=56747","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:53:30Z","sha256":"0d2bfa82ae10997abca228e10ecc48a3c991aa4cced6398a3c345e22e81684a9","source_id":"us-ky","stale":false,"prev":"us-ky/krs-278.274","next":"us-ky/krs-278.280"},"notice":"GroundRules: Original legal text.
