{"data":{"id":"us-ky/krs-278.455","jurisdiction":"us-ky","citation":"KRS 278.455","heading":"Reduction of operating expenses by G\u0026T or distribution cooperative --","body":"Effect on rates -- Authority for administrative regulations.\n(1) Notwithstanding any other statute to the contrary, a G\u0026T or distribution cooperative\nmay at any time decrease regula ted operating revenues by an amount to be\ndetermined solely by the cooperative utility. If the revenue reduction is allocated\namong and within the consumer classes on a proportional basis that will result in no\nchange in the rate design currently in effect , the revised rates and tariffs shall be\nauthorized and made permanent on the proposed effective date.\n(2) Notwithstanding any other statute, any revenue increase authorized by the Public\nService Commission or any revenue decrease authorized in subsection (1) of this\nsection that is to flow through the effects of an increase or decrease in wholesale\nrates may, at the distribution cooperative's discretion, be allocated to each class and\nwithin each tariff on a proportional basis that will result in no change  in the rate\ndesign currently in effect. In the event of an increase in the wholesale rates and\ntariffs of the wholesale supplier by the Public Service Commission, the rates and\ntariffs of the distribution cooperative that have been revised on a proportion al basis\nto result in no change in the rate design shall be authorized and shall become\neffective on the same date as those of the wholesale supplier. In those cases where\nan interim increase in the power supplier's wholesale rates is authorized, the\ndistribution cooperative's flow through rates shall be interim. The distribution\ncooperative's permanent rates and tariffs shall become effective on the date that the\nwholesale supplier's permanent rates become effective as ordered by the\ncommission.\n(3) Any ra te increase or decrease as provided for in subsections (1) and (2) of this\nsection shall not apply to special contracts under which the rates are subject to\nchange or adjustment only as stipulated in the contract.\n(4) The Public Service Commission shall pr omulgate administrative regulations\npursuant to KRS Chapter 13A to establish filing requirements and notice\nrequirements to the commission, the Attorney General, and the public under this\nsection.","path":["KRS Chapter 278"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=14119","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:53:30Z","sha256":"00b4143171aad41b7c16e05888411eb46e9ba1837448dfb77ae8aa03d4da8a63","source_id":"us-ky","stale":false,"prev":"us-ky/krs-278.450","next":"us-ky/krs-278.457"},"notice":"GroundRules: Original legal text.
