{"data":{"id":"us-ky/krs-278.495","jurisdiction":"us-ky","citation":"KRS 278.495","heading":"Authority to regulate safety aspects of natural gas facilities.","body":"(1) As used in this section:\n(a) \"Carbon dioxide transmission pipeline\" means the in -state portion of a\npipeline, including appurtenant facilities, property rights, and easements, that\nis used exclusively for the purpose of transporting carbon dioxide to a point of\nsale, storage, or other carbon management applications; and\n(b) \"Master meter system\" means a pipeline system for distributing gas within a\ndefinable area, such as, but not limited to, a mobile home park, housing\nproject, or apartment complex, where the operator purchases metered gas from\nan outside source for resale through a gas distribution pipeline system. The\ngas distribution pipeline system supplies the ultimate consumer, who either\npurchases the gas directly through a meter or by other means, s uch as through\nrents.\n(2) Notwithstanding any other provision of law, the commission shall have the\nauthority to regulate the safety of natural gas facilities which are:\n(a) Owned or operated by any public utility, county, or city, and used to distribute\nnatural gas at retail; or\n(b) Comprising a master meter system.\nThe commission may exercise this authority in conjunction with, and pursuant to,\nits authority to enforce any minimum safety standard adopted by the United States\nDepartment of Transportation pursuant to 49 U.S.C. sec. 60101 et seq., or any\namendments thereto, and may promulgate administrative regulations consistent with\nfederal pipeline safety laws in accordance with provisions of KRS Chapter 13A as\nare necessary to promote pipeline safety in the Commonwealth. In exercising this\nauthority, however, the commission shall consider the impact of any action it takes\non small businesses engaged in the installation and servicing of gas lines, master\nmeter systems, or related equipment and shall act so  as to ensure that no unfair\ncompetitive advantage is given to utilities over such small businesses.","path":["KRS Chapter 278"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=39833","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:53:30Z","sha256":"6eeda9912e2c0da722cebe629a892052c583f9c16c5e1edbe88ca5931bd5daa7","source_id":"us-ky","stale":false,"prev":"us-ky/krs-278.490","next":"us-ky/krs-278.500"},"notice":"GroundRules: Original legal text.
