{"data":{"id":"us-ky/krs-278.514","jurisdiction":"us-ky","citation":"KRS 278.514","heading":"Exempted service not to be subsidized by nonexempted, regulated","body":"telecommunications services.\n(1) Revenues derived from nonexempted, regulated telecommunications services,\nwhether essential or nonessential, shall not be used to subsidize or otherwise g ive\nadvantage to any person providing an exempted service. The commission shall\nrequire a provider of any exempted service to keep separate accounts, to allocate\ncost in accordance with procedures established by the commission, and may require\nother acts t hat will assist the commission in enforcing this section. Any person\nrequesting an exemption or providing a service exempted pursuant to KRS 278.512\nshall have the burden of proof to show compliance with this requirement.\n(2) (a) Except as provided in subs ection (2)(b) of this section, any\ntelecommunications utility that willfully violates subsection (1) of this section\nshall be subject to a penalty no greater than the revenue requirement effect of\nmoneys determined to have been misallocated in the violatio n. For the\npurpose of calculating the penalty under this section, the commission shall not\nuse a period longer than five (5) years.\n(b) A local exchange carrier with fewer than thirty -five thousand (35,000) access\nlines who willfully violates subsection (1 ) of this section shall be subject to\nthe penalties prescribed in KRS 278.990(1).","path":["KRS Chapter 278"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=14143","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:53:30Z","sha256":"8f598578d584c61b9642c54a0b16f38edc7cab23fa65691293c9d56768e0ccbf","source_id":"us-ky","stale":false,"prev":"us-ky/krs-278.512","next":"us-ky/krs-278.516"},"notice":"GroundRules: Original legal text.
