{"data":{"id":"us-ky/krs-278.541","jurisdiction":"us-ky","citation":"KRS 278.541","heading":"Definitions for KRS 278.541 to 278.544.","body":"In addition to the definitions set forth in KRS 278.010 and 278.516(2), the following\ndefinitions shall apply to KRS 278.541 to 278.544:\n(1) \"Basic local exchange service\" means a retail telecommunications service\nconsisting of a primary, single, voice -grade line provided to the premises of\nresidential or business customers with the following features and functions only:\n(a) Unlimited calls within the telephone utility's local exchange area;\n(b) Dual-tone multifrequency dialing; and\n(c) Access to the following:\n1. 911 emergency service;\n2. All locally available interexchange companies;\n3. Directory assistance;\n4. Operator services;\n5. Relay services; and\n6. A standard alphabetical directory listing that includes names, addresses,\nand telephone numbers at no additional charge.\nWith respect to local exchange carriers, basic local exchange service also shall\ninclude any mandatory extended area service routes accessible as a local call within\nthat exchange area on or before July 12, 2006. Basic local exchange se rvice does\nnot include any features or functions other than those listed in this subsection, nor\nany other communications service, even if such service should include features and\nfunctions listed herein;\n(2) \"Electing u tility\" means a telephone utility that elects to operate under KRS\n278.543;\n(3) \"Local exchange carrier\" or \"LEC\" has the same meaning as defined in 47 U.S.C.\nsec. 153(26);\n(4) \"Incumbent local exchange carrier\" or \"ILEC\" has the same meaning as defined in\n47 U.S.C. sec. 251(h);\n(5) \"Nonbasic service\" means all retail telecommunications services provided to a\nresidential or business customer, all arrangements with respect to those services,\nand all packages of products or services; provided, however, nonbas ic service\nincludes basic local exchange service only if the customer chooses to purchase a\npackage that includes basic local exchange service as a component of the package;\n(6) \"Optional telephone feature\" means any of those central office -based features that\nwere tariffed by a local exchange carrier on or before February 1, 2006, that, where\navailable:\n(a) Are available to a line-side connection in a telephone switch:\n(b) Are available on a stand-alone basis separate from a bundled offering; and\n(c) Enhance the utility of basic local exchange service.\nThe term includes but is not limited to call forwarding, call waiting, and caller ID;\n(7) \"Package\" means combinations of retail products or services offered, whether at a\nsingle price or with the availabili ty of the price for one (1) product or service\ncontingent on the purchase of others; and\n(8) \"Telephone utility\" includes local exchange carriers and telecommunications\ncarriers as those terms are defined in 47 U.S.C. sec. 153 and any federal regulations\nimplementing that section, except that the definition shall not include commercial\nmobile radio service providers as defined in 47 U.S.C. sec. 332 and the Federal\nCommunications Commission's lawful regulations promulgated thereunder.","path":["KRS Chapter 278"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=45297","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:53:30Z","sha256":"aa923c597938d7f047e19a523f694a70cd4772827fc401bf60a1c391cccb55c3","source_id":"us-ky","stale":false,"prev":"us-ky/krs-278.540","next":"us-ky/krs-278.542"},"notice":"GroundRules: Original legal text.
