{"data":{"id":"us-ky/krs-278.544","jurisdiction":"us-ky","citation":"KRS 278.544","heading":"Provisions applicable to all telephone utilities.","body":"The following provisions of this section shall apply and be enforced equally to all\ntelephone utilities, unless otherwise specifically stated in this section.\n(1) Telephone utilities may file with the commission schedules or tariffs reflecting the\nrates, terms, and conditions for nonbasic services that are generally available to all\nsubscribers qualifying for the rates, terms, and conditions. The rates, terms, and\nconditions for basic and nonbasic services shall be valid upon the effective date\nstated in the schedule. Tariffs for nonbasic services in effect on July 12, 2006, shall\ncontinue to be effective as binding rates, terms, and conditions until withdrawn or\nmodified by the telephone utility.\n(2) A telephone utility offering a package that includes any optional telephone features\ntariffed as of February 1, 2006, shall maintain schedules or tariffs on file with the\ncommission for each such optional telephone feature available on a stand -alone\nbasis to residential customers who purchase basic local exchang e service from that\ntelephone utility.\n(3) Notwithstanding the terms of any adopted regulation plan or any provision of law to\nthe contrary, telephone utilities may provide nonbasic services pursuant to terms\nand conditions provided to the customer. Telephone utilities shall not be required to\nfile nonbasic contracts with the commission. Telephone utilities shall permit a\nresidential customer with nonbasic service to purchase basic local exchange service\nand any optional telephone feature on file in a sched ule or tariff at the commission\nat the current rates, terms, and conditions without incurring termination charges,\nunless the customer has entered into an agreement containing termination charges\nand the customer is given thirty (30) days from receipt of t he terms and conditions\nto cancel the agreement. If a customer cancels the agreement within thirty (30) days\nfrom receipt of the terms and conditions, termination charges are limited to the price\nof unreturned equipment or services, including installation,  received at that point.\nTelephone utilities that provide services pursuant to this subsection shall provide\ncustomers with notice, as part of the terms and conditions of such services, that\nbasic local exchange service and any optional telephone feature on file in a schedule\nor tariff with the commission may be purchased separately at the price posted on the\ncompany's Web site or on file with the commission.\n(4) Notwithstanding any provision of law to the contrary, nonbasic services offered\npursuant to the provisions of this section shall be set by the marketplace and are not\ngoverned by KRS 278.030 and administrative regulations promulgated thereunder.\nThe nonbasic services are exempt from action or review by the commission under\nKRS 278.160, 278.170, 278. 180, 278.190, 278.192, 278.200, 278.230(3), 278.250,\n278.255, 278.260, 278.270, 278.280, 278.290, and 278.300 and administrative\nregulations promulgated thereunder, except as specifically stated in KRS 278.541 to\n278.544.","path":["KRS Chapter 278"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=14152","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:53:30Z","sha256":"a7806c6a95bb704e3222940311f262e2f40c993d056c605a9270920e2e9d8a60","source_id":"us-ky","stale":false,"prev":"us-ky/krs-278.5435","next":"us-ky/krs-278.545"},"notice":"GroundRules: Original legal text.
