{"data":{"id":"us-ky/krs-278.54611","jurisdiction":"us-ky","citation":"KRS 278.54611","heading":"Commission's jurisdiction over commercial mobile radio service,","body":"interconnection agreements, telecommunications carriers, and cellular towers.\n(1) The provision of commercial mobile radio services shall be market -based and not\nsubject to Public Ser vice Commission regulation. Notwithstanding any other\nprovision of law to the contrary, except as provided in subsections (2) to (5) of this\nsection, the commission shall not impose any requirement upon a commercial\nmobile radio services provider with respect to the following:\n(a) The availability of facilities or equipment used to provide commercial mobile\nradio services; or\n(b) The rates, terms, and conditions for, or entry into, the provision of commercial\nmobile radio service.\n(2) The provisions of this  section do not limit or modify the commission's authority to\narbitrate and enforce interconnection agreements.\n(3) The commission may assist in the resolution of consumer complaints.\n(4) The commission may exercise its authority to ensure that companies t hat are\ndesignated and operate as eligible telecommunications carriers under 47 U.S.C. sec.\n214(e), including commercial mobile radio service providers that receive eligible\ntelecommunications carrier status, comply with the Federal Communication\nCommission's rules in 47 C.F.R. pt. 54, which govern eligible telecommunications\ncarriers, to the extent consistent with federal and state law.\n(5) The commission shall retain jurisdiction over cellular towers pursuant to KRS\n278.665.","path":["KRS Chapter 278"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=44032","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:53:30Z","sha256":"10e423794da6a24c3e50e6b7880844732c61cad70043c104165ef08a7ca64619","source_id":"us-ky","stale":false,"prev":"us-ky/krs-278.5461","next":"us-ky/krs-278.5462"},"notice":"GroundRules: Original legal text.
