{"data":{"id":"us-ky/krs-278.615","jurisdiction":"us-ky","citation":"KRS 278.615","heading":"Cost recovery for certain nuclear energy generating facility permits and","body":"licenses -- Definitions for section.\n(1) As used in this section:\n(a) \"Combined operating license\" means a license issued by the United States\nNuclear Regulatory Commission pursuant to 10 C.F.R. sec. 52.71 et seq., that\nenables its holder to construct and operate a nuclear power plant at a specific\nsite;\n(b) \"Construction permit\" means a permit issued by the United States Nuclear\nRegulatory Commission pursuant to 10 C.F.R. pt. 50 that enables its holder to\nconstruct a nuclear power plant at a specific site;\n(c) \"Early site permit\" means a permit issued by the United States Nuclear\nRegulatory Commission pursuant to 10 C.F.R. sec. 52.12 et seq., that enables\nits holder to secure federal site approval for a nuclear power plant site prior to\nseeking an operating reactor license from the United States Nuclear\nRegulatory Commission;\n(d) \"Generation III Plus\" means the generation of nuclear reactor design\nfollowing Generation III that incorporates passive and other safety measures\nand design improvements not included in previous nuclear reactor designs;\n(e) \"Generation IV\" means the nuclear reactor designs identified and selected by\nthe Generation IV International Forum as follows:\n1. Sodium-cooled fast reactors;\n2. Gas-cooled fast reactors;\n3. Lead-cooled fast reactors;\n4. Molten salt reactors;\n5. Supercritical water-cooled reactors; and\n6. Very high temperature reactors; and\n(f) \"Nuclear energy generating facility\" means a facility containing a nuclear\nreactor of Generation III Plus, Generation IV, or later design that produces\nelectricity, at least some of which is sold to the public.\n(2) (a) Notwithstanding any provision of law to the contrary, upon application by a\nregulated utility, the commission may allow for the recovery of costs which\nare not covered in the existing rates of the utility that have been incurred in\napplying for and procuring an early site permit, construction  permit, or\ncombined operating license for a new nuclear energy generating facility to be\nlocated within the Commonwealth.\n(b) The commission shall not allow cost recovery under this section for any\namounts that have been offset by grant funding awarded pu rsuant to KRS\n164.2805.","path":["KRS Chapter 278"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=57401","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:53:31Z","sha256":"6b7657e60d351f018a18932cce5d530040679d8632e2441dd977bab75e14fc3d","source_id":"us-ky","stale":false,"prev":"us-ky/krs-278.610","next":"us-ky/krs-278.650"},"notice":"GroundRules: Original legal text.
