{"data":{"id":"us-ky/krs-278.665","jurisdiction":"us-ky","citation":"KRS 278.665","heading":"Administrative regulations governing cellular antenna towers to be","body":"constructed outside the jurisdiction of a planning commission.\n(1) The commission shall, by administrative regulation promulgated in accordance with\nKRS Chapter 13A, establish the mini mum content of an application for a certificate\nof convenience and necessity to construct cellular antenna towers for areas outside\nthe jurisdiction of a planning commission.\n(2) The commission, in establishing the public notice requirements of an applicat ion as\nprovided for in subsection (1) of this section, shall distinguish between areas of low\nand high population densities. At a minimum, when the site of the proposed cellular\nantenna tower is outside of an incorporated city, the commission shall require  that\nevery person who owns property contiguous to the property where the proposed\ncellular antenna tower will be located receives notice by certified mail, return\nreceipt requested, of the proposed construction, given the commission docket\nnumber under wh ich the application will be processed, and informed of the\nopportunity to intervene in the commission proceedings on the application.","path":["KRS Chapter 278"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=14171","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:53:31Z","sha256":"86b21fddd15dad7dc3caaec422564ef358ca5ddc7017d1e5edb66ec1d5bb8fef","source_id":"us-ky","stale":false,"prev":"us-ky/krs-278.660","next":"us-ky/krs-278.670"},"notice":"GroundRules: Original legal text.
