{"data":{"id":"us-ky/krs-278.692","jurisdiction":"us-ky","citation":"KRS 278.692","heading":"Financing statement maintained by Secretary of State -- Perfection of a","body":"security interest by filing of financing statement.\n(1) The Secretary of State shall maintain any financing statement filed to perfect a sale\nor other transfer of securit ized property and any security interest in securitized\nproperty under KRS 278.670 to 278.696 and 65.114 in the same manner that the\nSecretary of State maintains financing statements filed under the code to perfect a\nsecurity interest in collateral owned by a transmitting utility.\n(2) Except as otherwise provided in this section, all financing statements filed pursuant\nto this section shall be governed by the provisions regarding financing statements\nand the filing thereof under the code, including Article 9 , Part 5 of the code. A\nsecurity interest in securitized property may be perfected only by the filing of a\nfinancing statement in accordance with this section, and no other method of\nperfection shall be effective. Notwithstanding any provision of the code to the\ncontrary, a financing statement filed pursuant to this section shall be effective until\na termination statement is filed under the code, and no continuation statement shall\nneed to be filed to maintain its effectiveness.\n(3) A financing statement filed pursuant to this section may indicate that the debtor is a\ntransmitting utility, and without regard to whether the debtor is an electric utility, an\nassignee, or otherwise qualifies as a transmitting utility under the code, but the\nfailure to make a tr ansmitting utility's indication shall not impair the duration and\neffectiveness of the financing statement.","path":["KRS Chapter 278"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=53811","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:53:31Z","sha256":"f8712e8ce8ae23675342c088101a545b1f9c4ae49cc11f8d3f4e483eae4de466","source_id":"us-ky","stale":false,"prev":"us-ky/krs-278.690","next":"us-ky/krs-278.694"},"notice":"GroundRules: Original legal text.
