{"data":{"id":"us-ky/krs-278.992","jurisdiction":"us-ky","citation":"KRS 278.992","heading":"Penalty for certain pipeline violations.","body":"(1) Any person who violates any minimum safety standard adopted by the United States\nDepartment of Transportation pursuant to the federal pipeline safety laws, 49 U.S.C.\nsecs. 60101 et seq., as amended, or any regulation adopted and filed pursuant to\nKRS Chapt er 13A by the Public Service Commission governing the safety of\npipeline facilities or the transportation of gas as those terms are defined in the\nNatural Gas Pipeline Safety Act, shall be subject to a civil penalty to be assessed by\nthe Public Service Com mission not to exceed the maximum civil penalty as\ncontained in 49 C.F.R. sec. 190.223, as amended, for a violation of any provision of\n49 U.S.C. secs. 60101 et seq., or any regulation or order issued thereunder, for each\nviolation for each day that the vi olation persists. Any civil penalty assessed for a\nviolation may be compromised by the commission. In determining the amount of\nthe penalty, or the amount agreed upon in compromise, the appropriateness of the\npenalty to the size of the business of the person charged, the gravity of the violation,\nand the good faith of the person charged in attempting to achieve compliance, after\nnotification of the violation, shall be considered. The amount of the penalty, when\nfinally determined, or the amount agreed upon in compromise, may be deducted\nfrom any sums owing by the Commonwealth of Kentucky to the person charged or\nmay be recovered in a civil action in the Franklin Circuit Court.\n(2) Any person who willfully and knowingly defaces, damages, removes, or destroys\nany pipeline sign or right -of-way marker required by the Natural Gas Pipeline\nSafety Act or any regulation or order issued pursuant to it shall, upon conviction, be\nsubject for each offense to a fine of not more than five thousand dollars ($5,000),\nimprisonment for a term not to exceed one (1) year, or both.","path":["KRS Chapter 278"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=47695","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:53:31Z","sha256":"5de5fbbb9b28eb554685bdf4de2e9bf2ed827a04e4c726682d7d9a9c0a3a3bfc","source_id":"us-ky","stale":false,"prev":"us-ky/krs-278.990","next":"us-ky/krs-279.010"},"notice":"GroundRules: Original legal text.
