{"data":{"id":"us-ky/krs-27a.097","jurisdiction":"us-ky","citation":"KRS 27A.097","heading":"Evidence -based practices to be used in supervision and intervention","body":"programs -- Standards -- Funding restrictions.\n(1) As used in this section, \"evidence -based practices\" means intervention programs\nand supervision policies, procedures, programs,  and practices that scientific\nresearch demonstrates reduce instances of a defendant's failure to appear in court\nand criminal activity among defendants when implemented competently.\n(2) In order to increase the effectiveness of supervision and interventio n programs\nfunded by the state and provided to defendants, the Supreme Court shall require that\na vendor or contractor providing supervision and intervention programs for adult\ncriminal defendants use evidence-based practices.\n(3) The Supreme Court shall m easure the effectiveness of supervision and intervention\nprograms provided by vendors or contractors and demonstrate that the programs\nhave a documented evidence base and have been evaluated for effectiveness in\nreducing a defendant's failure to appear in court and criminal activity.\n(4) The Supreme Court shall require, at a minimum, the following:\n(a) A process for reviewing the objective criteria for evidence -based practices\nestablished by the vendor or contractor providing the program;\n(b) A process for auditing the effectiveness of the program;\n(c) An opportunity for programs that do not meet the criteria based on the audit\nresults to improve performance; and\n(d) A mechanism to defund any program provided by a vendor or contractor that\ndoes not meet the criteria upon a second audit.\n(5) Beginning July 1, 2012, twenty -five percent (25%) of state moneys expended on\nsupervision and intervention programs for pretrial defendants shall be for programs\nthat are in accordance with evidence -based practices. Beginning July 1, 2014, fifty\npercent (50%) of state moneys expended on supervision and intervention programs\nshall be for programs that are in accordance with evidence -based practices.\nBeginning July 1, 2016, and thereafter, seventy -five percent (75%) of state moneys\nexpended on supervision and intervention programs shall be for programs that are in\naccordance with evidence-based practices.","path":["KRS Chapter 27A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=42272","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:48:47Z","sha256":"9bdcc9136c21937bd9e9cc6973372bf65a2f6d8326c20d5deca6389178802f7f","source_id":"us-ky","stale":false,"prev":"us-ky/krs-27a.096","next":"us-ky/krs-27a.098"},"notice":"GroundRules: Original legal text.
