{"data":{"id":"us-ky/krs-27a.630","jurisdiction":"us-ky","citation":"KRS 27A.630","heading":"Access to Justice Fee -- Deposit in State Treasury -- Distribution of fees","body":"collected -- Funding of legal services for children.\n(1) Upon receipt of notice of designation of an agency by the circuit clerk, there shall\nbe added to the filing fee in all civil actions filed in Circuit Court the sum of twenty\ndollars ($20), and to all civil actions filed in District Court, the sum of ten dollars\n($10). No fee shall be charged for actions filed in neglect and dependency cases.\nThis fee shall be designated as the Access to Justice Fee, and shall be charged at the\ntime of filing of the first papers in the action.\n(2) All fees collected pursuant to subsection (1) of this section during each month shall\nbe placed in the general fund of the State Treasury, and app ropriated in accordance\nwith subsection (3) of this section. The clerks shall make a full report with the\npayment and receive a receipt for all payments.\n(3) Fees collected shall be distributed monthly to the designated agencies on a pro rata\nbasis, utilizing an allocation formula that distributes funds for each judicial district\nserved, according to the proportion of the number of residents of that judicial\ndistrict whose incomes are less than the official United States federal poverty\nguidelines, based on  latest published United States census data, as a percentage of\nthe total number of these residents in the Commonwealth of Kentucky. These funds\nshall be used by the designated agency to carry out the duties prescribed in KRS\n27A.610.\n(4) All unused or unc ommitted funds received by a designated agency during its fiscal\nyear shall be returned by the designated agency to the State Treasury, to be\nredistributed in the following calendar quarter to operating designated agencies in\naccordance with administrative  regulations promulgated by the Administrative\nOffice of the Courts.\n(5) Notwithstanding the provisions of subsections (1) to (4) of this section, an amount\nnot to exceed two hundred thousand dollars ($200,000) from the fee imposed under\nsubsection (1) of this section shall be appropriated to organizations that specialize\nin providing legal representation and services to children.","path":["KRS Chapter 27A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=20972","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:48:47Z","sha256":"d5b5ba02510a70015f2944a38f1e0ae23f09ab035ccc6aa92dfa336cea7b1690","source_id":"us-ky","stale":false,"prev":"us-ky/krs-27a.620","next":"us-ky/krs-27a.640"},"notice":"GroundRules: Original legal text.
