{"data":{"id":"us-ky/krs-280.030","jurisdiction":"us-ky","citation":"KRS 280.030","heading":"Application for certificate -- When granted.","body":"(1) Every person applying for a certificate of convenience and necessity under KRS\n280.020 shall, at the time of application, make and file with the Department of\nHighways a statement in a form as the department prescribes.\n(2) The statement shall, in addition  to any other information required by the\ndepartment, contain:\n(a) The name of the applicant;\n(b) The nature of the applicant, whether an individual, association, or corporation,\nand under the laws of what state organized;\n(c) The location of its principal office;\n(d) The names and post office addresses of its president, secretary, auditor,\ntreasurer, and superintendent or manager;\n(e) The name and post office address of its chief officer or managing agent in this\nstate;\n(f) The location of the termini betw een which it transacts its ferry or bridge\nbusiness;\n(g) The number and capacity of boats or other vehicles owned and used for the\nferry or the width of driveway of the bridge;\n(h) The schedule of hours of service and trips made; and\n(i) The schedule showing the rates to be charged and the classification of patrons\nby rates.\n(3) The statement shall be made under the oath of the applicant or, if the applicant is an\nassociation or corporation, under the oath of its president, secretary, treasurer,\nsuperintendent or manager.\n(4) The department shall, after the filing of the application, fix a date for a public\nhearing on the application, which shall be within thirty (30) days after the filing.\nThe applicant shall give notice of the filing of the application by publication\npursuant to KRS Chapter 424.\n(5) If it is made to appear to the department that public convenience and necessity\nrequires the operation of the bridge or ferry, the department shall grant the\ncertificate.
