{"data":{"id":"us-ky/krs-281.592","jurisdiction":"us-ky","citation":"KRS 281.592","heading":"Motor carrier transportation contracts -- When against public policy and","body":"void and unenforceable.\n(1) As used in this section:\n(a) \"Motor carrier transportation contract\" means a contract, agreement, or\nunderstanding covering:\n1. The transportation of property for compensation or hire by a motor\ncarrier;\n2. The entrance on property by a motor carrier for the purpose of loading,\nunloading, or transporting property for compensation or hire; or\n3. A service incidental to activity described in subparagraph 1. or 2. of this\nparagraph, including but not limited to storage of property; and\n(b) \"Promisee\" means a person with whom a motor carrier enters into a motor\ncarrier transportation contract and any agents, employees, servants, or\nindependent contractors wh o are directly responsible to that person.\n\"Promisee\" does not include the motor carrier party to a motor carrier\ntransportation contract with the promisee, and the motor carrier's agents,\nemployees, servants, or independent contractors directly responsibl e to the\nmotor carrier.\n(2) A provision, clause, covenant, or agreement contained in, collateral to, or affecting\na motor carrier transportation contract that purports to indemnify, defend, or hold\nthe promisee harmless, or has the effect of indemnifying, defending, or holding the\npromisee harmless, or requires a motor carrier to procure liability insurance\ncovering the acts or omissions or both of the promisee, from or against any liability\nfor loss or damage resulting from the negligence or intentional ac ts or omissions of\nthe promisee, is against public policy and is void and unenforceable.\n(3) This section shall not apply to the Uniform Intermodal Interchange and Facilities\nAccess Agreement administered by the Intermodal Association of North America or\nother agreements providing for the interchange, use, or possession of intermodal\nchassis or other intermodal equipment.","path":["KRS Chapter 281"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=43237","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:53:33Z","sha256":"85e2ee81e731870bd11fc07e28ac33d6970f8d8dc3a0f640c30fb424cfecf6ee","source_id":"us-ky","stale":false,"prev":"us-ky/krs-281.590","next":"us-ky/krs-281.595"},"notice":"GroundRules: Original legal text.
