{"data":{"id":"us-ky/krs-281.630","jurisdiction":"us-ky","citation":"KRS 281.630","heading":"Certificates issued by department -- Applications -- Fees -- Renewal --","body":"Information to be filed -- Agents of utility trailer lessor -- Prohibition against\nemploying services of unauthorized motor carrier -- Powers of department\nrelating to rates,  services, and facilities -- Hearings -- Administrative\nregulations.\n(1) A person shall not act as a motor carrier without first obtaining a certificate from\nthe department.\n(2) A certificate for the intrastate transportation of passengers or  property, including\nhousehold goods, shall be issued to any qualified applicant authorizing operation\ncovered by the application, if it is found that the applicant conforms to the\nprovisions of this chapter and the requirements of the administrative regul ations\npromulgated in accordance with this section.\n(3) (a) The department shall issue the following certificates:\n1. Taxicab certificate;\n2. Limousine certificate;\n3. Disabled persons vehicle certificate;\n4. Transportation network company certificate;\n5. Household goods certificate;\n6. Charter bus certificate;\n7. Bus certificate;\n8. U-Drive-It certificate;\n9. Property certificate;\n10. Driveaway certificate;\n11. Peer-to-peer car sharing certificate;\n12. Automobile utility trailer certificate; and\n13. Towing and storage certificate.\n(b) Application for a certificate shall be made in such form as the department may\nrequire. The department shall receive an application fee of two hundred fifty\ndollars ($250) for all applications, except that the department shall receive an\napplication fee of twenty-five dollars ($25) for a property certificate.\n(c) Before the department may issue a certificate, an applicant shall:\n1. Pay the application fee established under p aragraph (b) of this\nsubsection;\n2. For entities other than TNCs and peer -to-peer car sharing companies,\nfile a motor carrier vehicle license application for each motor carrier\nvehicle as required by KRS 281.631. The applicant shall file at least one\n(1) motor carrier vehicle license application before being eligible for a\ncertificate;\n3. For TNCs, file a TNC authority application with the department\npursuant to administrative regulations promulgated by the department;\n4. For peer-to-peer car sharing compan ies, file a peer -to-peer car sharing\ncertificate application with the department pursuant to administrative\nregulations promulgated by the department;\n5. File with the department one (1) or more approved indemnifying bonds\nor insurance policies as required by KRS 281.655;\n6. For taxicab, limousine, disabled persons vehicle, TNC, household\ngoods, charter bus, and bus certificates, obtain and retain for a period of\nat least three (3) years, a nationwide criminal background check, in\ncompliance with KRS 281.63 01, of each owner, official, employee,\nindependent contractor, or agent operating a passenger vehicle or\nhousehold goods vehicle or entering a private residence or storage\nfacility for the purpose of providing or facilitating the transportation of\nhousehold goods;\n7. For household goods certificates, file with the department a current\ntariff;\n8. For a bus certificate, file with the department authorization from a city\nas required by KRS 281.635; and\n9. For towing and storage certificates, the applicant shal l have a rate sheet\non file with the department. All rates included shall be reasonable and\ncustomary to Kentucky.\n(4) (a) Every certificate shall be renewed annually. Application for renewal shall be\nin such form as the department may require.\n(b) A certificate not renewed within one (1) calendar year after the date for its\nrenewal shall become null and void.\n(c) The department shall not renew any certificate if it has been revoked or, if\nsuspended, during the period of any suspension. A certificate shall not be\nconsidered revoked or suspended when an appeal of the revocation or\nsuspension is pending in a court of competent jurisdiction.\n(d) For the renewal of an intrastate certificate, the department shall receive a fee\nof two hundred fifty dollars ($250),  except for an application for renewal of a\nproperty certificate, for which the department shall receive a fee of twenty -\nfive dollars ($25).\n(e) Before the department may renew a certificate, the certificate holder shall:\n1. Pay the renewal fee established under paragraph (d) of this subsection;\n2. For the entities other than TNCs and peer -to-peer car sharing\ncompanies, file a motor carrier vehicle license application or renewal for\neach motor carrier vehicle as required by KRS 281.631. The certificate\nholder shall file at least one (1) motor carrier vehicle license application\nor renewal before being eligible for renewal;\n3. For TNCs, file a TNC authority application with the department\npursuant to administrative regulations promulgated by the department;\n4. For peer-to-peer car sharing companies, file a peer -to-peer car sharing\ncertificate application with the department purs uant to administrative\nregulations promulgated by the department;\n5. File with the department one (1) or more approved indemnifying bonds\nor insurance policies as required by KRS 281.655;\n6. Every three (3) years, for taxicab, limousine, disabled persons v ehicle,\nTNC, household goods, charter bus, and bus certificates, obtain and\nretain for a period of at least three (3) years, a nationwide criminal\nbackground check in compliance with KRS 281.6301, of each owner,\nofficial, employee, independent contractor, or agent operating a\npassenger vehicle or entering a private residence or storage facility for\nthe purpose of providing or facilitating the transportation of household\ngoods. However, within the three (3) year period:\na. If a new owner, official, employee,  independent contractor, or\nagent joins the certificate holder and performs the aforementioned\nduties; or\nb. If the certificate holder has knowledge that a current owner,\nofficial, employee, independent contractor, or agent who performs\nthe aforementioned duties has been convicted of or pled guilty to\nany of the offenses listed in KRS 281.6301(2);\nthen the certificate holder shall obtain and retain for a period of at least\nthree (3) years, a nationwide criminal background check for that owner,\nofficial, employee, independent contractor, or agent;\n7. For household goods certificates, have on file with the department a\ncurrent tariff; and\n8. For towing and storage certificates, have on file with the department a\ncurrent rate sheet.\n(5) (a) A motor carrier ope rating under a household goods certificate shall, at all\ntimes the certificate is in effect, maintain on file with the department a current\ntariff.\n(b) Except for a household goods certificate holder that has had only an out -of-\nstate address on file with t he department prior to January 1, 2015, all\ncertificate holders shall maintain on file with the department an address within\nthe Commonwealth. The certificate holder shall keep open for public\ninspection at that address such information as the department may require.\n(c) The certificate holder shall not charge, demand, collect, or receive a greater,\nless, or different compensation for the transportation of household goods or\nfor any service in connection therewith, than the tariff filed with the\ndepartment and in effect at the time would require. A certificate holder shall\nnot make or give any unreasonable preference or advantage to any person, or\nsubject any person to any unreasonable discrimination.\n(6) A certificate shall not be transferred unless the tra nsfer involves either the change\nof the legal name of the existing certificate holder or the incorporation of a sole\nproprietor certificate holder.\n(7) A certificate authorizing a person to act as an automobile utility trailer lessor shall\nalso authorize the agents of the person to act on his or her behalf during the period\nof their agency.\n(8) A motor carrier vehicle shall not be operated after the expiration of the certificate\nunder which it is operated.\n(9) A person shall not knowingly employ the service s of a motor carrier not authorized\nto perform such services.\n(10) If the department, after a hearing held upon its own motion or upon complaint, finds\nany existing rate unjustly discriminatory, or finds the services rendered or facilities\nemployed by any motor carrier to be unsafe, inadequate, inconvenient, or in\nviolation of law or of the administrative regulations of the department, it may by\nfinal order do any or all of the following:\n(a) Require the certificate holder to follow any rate or time schedul e in effect at\nthe time of service;\n(b) Require the certificate holder to issue a refund to the complainant;\n(c) Require the certificate holder to pay the fine set out in KRS 281.990 to the\ndepartment; and\n(d) Determine the reasonable, safe, adequate, and convenient service to be\nthereafter furnished.\n(11) Hearings conducted under authority of this section shall be conducted in the same\nmanner as provided in KRS 281.640.\n(12) (a) Subject to the limitation of paragraph (b) of this subsection, the department\nshall have the power to promulgate administrative regulations as it may deem\nnecessary to carry out the provisions of this section.\n(b) Any administrative regulation that reasonably applies only to a human driver\nshall not apply to the operation of a fully  autonomous vehicle licensed under\nthis section.","path":["KRS Chapter 281"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=56533","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:53:33Z","sha256":"dc48a6078c2dd3849f4debb2f47fc734d4e9ca0e7200fa893c061f1f44931d3e","source_id":"us-ky","stale":false,"prev":"us-ky/krs-281.627","next":"us-ky/krs-281.6301"},"notice":"GroundRules: Original legal text.
