{"data":{"id":"us-ky/krs-281.687","jurisdiction":"us-ky","citation":"KRS 281.687","heading":"Vehicle license cost recovery fee charged by motor vehicle renting","body":"company.\n(1) As used in this section:\n(a) \"Motor vehicle renting company\" means a holder of a certificate as required\nunder KRS 281.630 to operate as a U -Drive-It, which regularly en gages in\nrenting or leasing motor vehicles to customers for less than a sixty (60) day\nterm as part of an established business;\n(b) \"Vehicle license costs\" means the costs incurred by a motor vehicle renting\ncompany for licensing, titling, registration, pr operty tax, plating, and\ninspecting rental motor vehicles; and\n(c) \"Vehicle license cost recovery fee\" means a charge on a vehicle rental\ntransaction originating within the Commonwealth that is separately stated on\nthe rental agreement to recover vehicle license costs.\n(2) (a) If a motor vehicle renting company includes a vehicle license cost recovery\nfee as a separately stated charge in a rental transaction, the amount of the fee\nshall represent the company's good -faith estimate of the motor vehicle rental\ncompany's daily charge to recover its actual total annual vehicle license costs.\n(b) If the total amount of the vehicle license cost recovery fees collected by a\nmotor vehicle renting company under this section in any calendar year exceeds\nthe company's actual vehicle license costs, the motor vehicle renting company\nshall:\n1. Retain the excess amount; and\n2. Adjust the vehicle cost recovery fee for the following calendar year by a\ncorresponding amount.\n(3) Nothing in this section shall prevent a motor vehi cle renting company from\nincluding, or making adjustments during the calendar year to, separately stated\nsurcharges, fees, or charges in the rental agreement, which may include but are not\nlimited to vehicle license cost recovery fees, airport access fees,  airport concession\nfees, consolidated facility charges, and all applicable taxes.","path":["KRS Chapter 281"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=44166","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:53:33Z","sha256":"621702cc2190f6ec1ad9d780e386aa17f25608c2a9d1c987913c21e9c374a1da","source_id":"us-ky","stale":false,"prev":"us-ky/krs-281.685","next":"us-ky/krs-281.690"},"notice":"GroundRules: Original legal text.
