{"data":{"id":"us-ky/krs-281.730","jurisdiction":"us-ky","citation":"KRS 281.730","heading":"Federal regulations on maximum driving and on -time duty -- Exemptions","body":"for agricultural commodities and farm supplies during planting and\nharvesting season.\n(1) As used in this section:\n(a) \"Agricultural commodity\" means any agricultural commo dity, nonprocessed\nfood, feed, fiber, or livestock;\n(b) \"Farm supplies for agricultural purposes\" means a product directly related to\nthe growing or harvesting of agricultural commodities; and\n(c) \"Planting and harvesting season\" means the period of time t hat begins on\nJanuary 1 and ends on December 31 of each year.\n(2) The secretary of the Transportation Cabinet may adopt by reference or set forth in\nits entirety the provisions of 49 C.F.R. sec. 350.341 and pt. 395 in effect as of July\n15, 1986, or as amended with respect to any motor vehicle registered in Kentucky.\n(3) The provisions of 49 C.F.R. pt. 395 adopted or set forth by the secretary of the\nTransportation Cabinet shall not apply during Kentucky's planting and harvesting\nseason to drivers transporting:\n(a) Agricultural commodities from the source of the agricultural commodities to a\nlocation within a one hundred fifty (150) air -mile radius from the source, or\nwithin the maximum radius from the source that is permitted by federal law,\nwhichever is greater;\n(b) Farm supplies for agricultural purposes from a wholesale or retail distribution\npoint of the farm supplies to a farm or other location where the farm supplies\nare intended to be used within a one hundred fifty (150) air -mile radius from\nthe distr ibution point, or within the maximum radius from the distribution\npoint that is permitted by federal law, whichever is greater; or\n(c) Farm supplies for agricultural purposes from a wholesale distribution point of\nthe farm supplies to a retail distribution  point of the farm supplies within a\none hundred fifty (150) air -mile radius from the wholesale distribution point,\nor within the maximum radius from the wholesale distribution point that is\npermitted by federal law, whichever is greater.\n(4) The provision s of this section shall be void if the Secretary of the United States\nDepartment of Transportation determines through a rulemaking proceeding that\nSection 345(a.)(1.) of the National Highway System Designation Act of 1995\npresents a hazard to the traveling public.","path":["KRS Chapter 281"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=47792","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:53:34Z","sha256":"aa195f788e813ec08a6ee6d7a90e8915d361224767ab69047f8200cfb87b8b79","source_id":"us-ky","stale":false,"prev":"us-ky/krs-281.728","next":"us-ky/krs-281.735"},"notice":"GroundRules: Original legal text.
