{"data":{"id":"us-ky/krs-281.875","jurisdiction":"us-ky","citation":"KRS 281.875","heading":"Administrative regulations governing human service transportation","body":"delivery program -- Requirement for documentation -- Preferential treatment\nby cabinet prohibited -- Handbook.\n(1) The cabinet shall promulgate administrative regulations governing, but  not limited\nto, the following provisions of the human service transportation delivery program:\n(a) Establishment of one (1) or more specific delivery areas;\n(b) The length of the term of the contract to be signed with a broker and the\ncriteria to be used to terminate a contract;\n(c) Contractual matters to be specified in a request for proposals from brokers\nincluding, but not limited to:\n1. Establishment and maintenance of a central business office within the\ndelivery area;\n2. Staffing requirements for the central business office;\n3. Collection and retention of records to be maintained by each broker and\nsubcontractor;\n4. Collection and retention of encounter data on each trip made by the\nbroker if the broker provides transportation services and by each\nsubcontractor. Failure of a broker to record all data required by the\ncabinet for all trips the broker provided under the human service\ntransportation delivery program shall be grounds for the cabinet to\nterminate the broker's contract;\n5. Reporting of all tr affic accidents and moving violations involving either\na broker or subcontractor; and\n6. Submission of annual financial reports by each broker;\n(d) Criteria for evaluating and selecting a broker subject to the provisions of\nsubsections (2) and (3) of this section;\n(e) Identification of all federal statutes, federal rules, and federal administrative\nregulations with which state agencies, brokers, and subcontractors must\ncomply;\n(f) Uniform criteria for establishing capitated rates, fees, and reimbursement\nprocedures for all delivery areas, including a mandate that brokers shall have\nall reports necessary for payment to the cabinet not later than the seventh of\neach month. The mandate shall also include a requirement that the cabinet\nshall pay brokers not lat er than the fifteenth of each month if the broker has\nsubmitted all required reports. A broker shall promptly reimburse\nsubcontractors within three (3) business days of payment by the cabinet;\n(g) Uniform responsibilities for all brokers and subcontractors  including\nprovisions for reservations and trip assignments, quality assurance,\nadministrative oversight, and reporting;\n(h) Uniform criteria for contractual agreements between subcontractors and\nbrokers in all delivery areas;\n(i) Uniform criteria governing the authorized provision of transportation services\noffered by brokers in all delivery areas;\n(j) Uniform guidelines brokers shall be required to adopt to educate persons in\nthe delivery area regarding:\n1. Procedures for scheduling transportation service s including the broker's\nnormal hours of operation and how to schedule transportation after\nnormal hours of operation, including Sundays and all holidays;\n2. Rates for services;\n3. Information the person shall be required to provide the broker when\nrequesting transportation;\n4. Types of eligible transportation, including pick -up and delivery\nstandards and reasons service may be denied;\n5. Permissibility of escorts and attendants;\n6. Procedures governing requests for urgent care;\n7. Standards for driver conduct;\n8. Standards for passenger conduct; and\n9. Oral and written instructions governing the complaint process and how\nto lodge a complaint against a subcontractor or broker;\n(k) Vehicle requirements governing all vehicles operated by brokers or\nsubcontractors to transport persons under the human service transportation\ndelivery program;\n(l) Driver qualifications including driver, attendant, and service personnel\ntraining;\n(m) Minimum standards to be included in a mandatory orientation program\nprovided by the broker for all subcontractors in the delivery area;\n(n) Minimum standards governing volunteer and public transportation services;\n(o) Minimum standards governing an operational procedures manual to be\ndeveloped by all brokers;\n(p) Minimum standards governing a quality assurance plan to be developed by all\nbrokers;\n(q) Performance monitoring by the cabinet of brokers and subcontractors; and\n(r) Standards governing uniform software that all brokers shall be required to use\nto ensure the uniform collection of  data and to facilitate the production and\nanalysis of uniform reports relating to the human service transportation\ndelivery system.\n(2) A person that submits a request for proposal to be a broker under the human service\ntransportation delivery program sha ll be required to submit documentation that he\nor she has at least one (1) year experience working with persons with special needs.\n(3) The cabinet shall be prohibited from awarding higher scores, or giving any type of\npreferential treatment to, any person  that submits a request for proposal to be a\nbroker who is also a transportation provider over a person who submits a request to\nbe a broker but who is not a transportation provider.\n(4) The cabinet shall develop a handbook specifying standard operating pr ocedures,\nwhich shall be distributed to all providers and shall be made available to the general\npublic.","path":["KRS Chapter 281"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=14444","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:53:34Z","sha256":"66882f910125041b68d1f02c8f379ab90bc4023cb838489f8d42acbcdc776c78","source_id":"us-ky","stale":false,"prev":"us-ky/krs-281.874","next":"us-ky/krs-281.876"},"notice":"GroundRules: Original legal text.
