{"data":{"id":"us-ky/krs-281.930","jurisdiction":"us-ky","citation":"KRS 281.930","heading":"Payment and release requirements for towed vehicles -- Storage fees.","body":"(1) This section applies to towing companies that tow and store motor vehicles, and to\nstorage facilities that store vehicles towed by a towing company, regardless of\nwhether the towing company and the storage facilities are affiliates.\n(2) Upon payment of all costs incurred against a motor vehicle towed and stored under\nthis chapter, the towing company or storage facility shall release the motor vehicle\nto:\n(a) A properly identified owner or lienholder of the motor vehicle; or\n(b) An authorized representative of the insurance company or its contracted\nservice provider insuring the motor vehicle if the:\n1. Motor vehicle is covered by an active policy of insurance and the\ninsurance representative provides proof of coverage; or\n2. Owner of the motor vehicle approves release of the vehicle to the\ninsurance company representative.\n(3) (a) Prior to payment of fees and release of the motor vehicle, a storage facility or\ntowing company shall not refuse the right of physical inspection of the towed\nvehicle during posted business hours by:\n1. An owner;\n2. A lienholder;\n3. A representative of the insurance company that insures the motor\nvehicle; or\n4. A contracted service provider of the insurance company.\n(b) The inspection of a vehicle that is being held as evidence by a law\nenforcement agency shall only occur if authorize d by the investigating law\nenforcement agency. The law enforcement agency may impose any or all of\nthe following restrictions:\n1. Restrict the inspection to visual and touchless only; or\n2. Require any persons or entities outlined in paragraph (a) of this\nsubsection to be accompanied by a law enforcement officer.\n(4) A towing company or storage facility shall accept payment made by any of the\nfollowing means from an individual seeking to release a motor vehicle:\n(a) Cash;\n(b) Check from an insurer or its agent;\n(c) Credit card;\n(d) Debit card;\n(e) Money order; or\n(f) Check drawn by a bank or other financial institution.\n(5) Upon receiving payment of all costs incurred against a motor vehicle, a towing\ncompany or storage facility shall provide to the person making payment an itemized\nreceipt in accordance with KRS 281.926(4) and (5) to the extent the information is\nknown or available.\n(6) A towing company or storage facility shall be open for business or accessible by\ntelephone during posted business hours. A towing company or storage facility shall\nprovide a telephone number available on a twenty -four (24) hour basis to receive\ncalls and messages from callers, including calls made outside posted business\nhours. All calls made to a towing company or storage fac ility shall be returned\nwithin twenty-four (24) hours from the time received. However, if adverse weather,\nan emergency situation, or another act over which the towing company or storage\nfacility has no control prevents the towing company or storage facili ty from\nreturning calls within twenty -four (24) hours, the towing company or storage\nfacility shall return all calls received as quickly as possible.\n(7) (a) Storage fees may be charged by a towing company or storage facility during a\nhold period initiated  for potential evidence in any criminal or civil\ninvestigation.\n(b) Subject to the conditions in paragraph (c) of this subsection, a reasonable\ndaily storage rate of no more than the daily storage rate included on the\npublished rate sheet may be charged du ring the hold period. A towing\ncompany or storage facility shall not charge any additional fee or combination\nof fees during the hold period other than:\n1. A daily storage fee; or\n2. Fees charged in accordance with the rate sheet for completed labor to\nassist with an inspection, as directed by the entity overseeing the\ninvestigation.\n(c) If an insurer offers to provide a secure facility for storage during the hold\nperiod at no cost, the entity requesting the hold may allow the vehicle to be\nmoved to the insurer's facility.\n(d) Upon release of the hold and payment from the owner or insurer for all towing\nand storage charges set forth by the published rate sheet, the vehicle shall be\nreleased to the owner, insurer, or representative of the insurer.","path":["KRS Chapter 281"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=56535","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:53:34Z","sha256":"5f4b12879777e7ab6cc026733740aa70fc63e4bfc6c380ae65a59ded679fc852","source_id":"us-ky","stale":false,"prev":"us-ky/krs-281.928","next":"us-ky/krs-281.932"},"notice":"GroundRules: Original legal text.
