{"data":{"id":"us-ky/krs-281.934","jurisdiction":"us-ky","citation":"KRS 281.934","heading":"Prohibited acts by towing company or storage facility.","body":"(1) A towing company shall not:\n(a) Falsely represent that the towing company represents or is approved by any\nlaw enforcement agency, or any organization that provides emergency road\nservice for disabled motor vehicles;\n(b) Require an owner or operator of a disabled motor vehicle to preauthorize more\nthan twenty -four (24) hours of storage or repair work as a condition to\nproviding towing service for the disabled vehicle;\n(c) Charge more than one (1) towing fee when the owner or operator of a disabled\nmotor vehicle requests transport of the motor vehicle to a repair facility owned\nor operated by the towing company; or\n(d) Tow a motor vehicle to a repair facility, unless the owner of the motor vehicle\nor the owner's designated representative gives consent and the consent is given\nprior to the removal of the motor vehicle from the location from which the\nmotor vehicle is to be towed. This paragraph shall not apply to a storage\nfacility that has a repair facility on the same site so long as the motor vehicle\nis not moved into the repair facility without consent.\n(2) A towing company or storage facility shall not:\n(a) Upon payment of all costs incurred against a motor vehicle towed and stored\nunder this chapter, refuse to release the motor vehicle to a properly ident ified\nowner or lienholder of the motor vehicle or to an authorized representative of\nthe insurance company insuring the motor vehicle or the insurance company's\ncontracted provider, if the motor vehicle is covered by an active policy of\ninsurance. Motor ve hicle release under this paragraph shall not apply to any\ncase in which a law enforcement agency has ordered the motor vehicle not to\nbe released or in any case in which a judicial order prohibits its release;\n(b) Refuse to permit a properly identified own er or lienholder of a motor vehicle\nor a representative of the insurance company insuring the motor vehicle if the\nmotor vehicle is covered by an active policy of insurance to inspect the motor\nvehicle during posted business hours before all costs incurred  against the\nmotor vehicle are paid or the motor vehicle is released; or\n(c) Charge a storage fee for a stored motor vehicle with respect to any day on\nwhich release of the motor vehicle or inspection of the motor vehicle by the\nowner, lienholder, or insur ance company is not permitted during posted\nbusiness hours by the towing company or storage facility.","path":["KRS Chapter 281"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=51081","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:53:34Z","sha256":"0d7b971423b5e4d4f6a8d70dded9650765070e629be159a4a062e143f5988404","source_id":"us-ky","stale":false,"prev":"us-ky/krs-281.932","next":"us-ky/krs-281.936"},"notice":"GroundRules: Original legal text.
