{"data":{"id":"us-ky/krs-281.990","jurisdiction":"us-ky","citation":"KRS 281.990","heading":"Penalties.","body":"(1) Except as provided in subsections (4) and (5) of this section, a person shall be fined\nnot less than twenty -five dollars ($25) and no more than two hundred dollars\n($200), if the person:\n(a) Violates, causes, aids, or abets any violation of the provisions of this chapter,\nor any order, rule, or administrative regulation lawfully issued pursuant to\nauthority granted by this chapter;\n(b) Knowingly makes any false or erroneous statement, report, or representation\nto the Department of Vehicle Regulation with re spect to any matter placed\nunder the jurisdiction of the department by this chapter;\n(c) Knowingly makes any false entry in the accounts or records required to be\nkept pursuant to the authority granted by this chapter; or\n(d) Knowingly fails to keep, or kn owingly destroys or mutilates, any accounts or\nrecords.\nEvery device to evade or to prevent the application of any provision of this chapter,\nor any lawful order, rule or administrative regulation of the department issued\npursuant thereto, shall constitute a violation thereof.\n(2) (a) Any person who violates KRS 281.630(1) or 281.631(1) shall be fined not\nless than five hundred dollars ($500) nor more than three thousand five\nhundred dollars ($3,500).\n(b) Any person who operates as a motor carrier in viola tion of the terms of his or\nher certificate or motor carrier vehicle license shall be fined not less than five\nhundred dollars ($500) nor more than three thousand five hundred dollars\n($3,500).\n(3) A person who violates KRS 281.630(9) shall not be subject to a penalty under this\nsection.\n(4) (a) Except as provided in this subsection, any person who violates KRS 281.757\nshall be fined two hundred fifty dollars ($250) for each offense.\n(b) A person who is cited for a violation of KRS 281.757 in which the lights were\ninoperable or the reflectors were missing may, within thirty (30) days from\nthe date of the citation, provide proof to the county attorney of the county in\nwhich the offense occurred that the mechanical problem has been repaired and\nthat the lights are in working order or that the required reflectors have been\nplaced on the vehicle. If such proof is shown, the citation shall be dismissed.\n(c) A law enforcement officer and the department shall  not issue a citation to a\nperson as violating KRS 281.757 if the atmospheric conditions all motorists\nwere subjected to at the time the person is stopped reasonably limit the ability\nof a person to keep the vehicle's lights or reflectors from being obscur ed by\ndirt, mud, or debris.\n(5) (a) A towing company or storage facility which violates KRS 281.920 to 281.936\nshall be subject the following administrative penalties levied by the cabinet:\n1. For each violation, up to four (4) violations within a three (3 ) year\nperiod, the towing company or storage facility shall have its certificate\nsuspended for thirty (30) days; and\n2. For each subsequent violation within a three (3) year period, a towing\ncompany or storage facility shall have its certificate suspended for\ntwelve (12) months.\n(b) During a period when a towing company or storage facility has had its\ncertificate suspended, the towing company or storage facility shall not charge\nfees.\n(6) The cabinet may promulgate administrative regulations in accordance w ith KRS\nChapter 13A to set additional penalties for violations of KRS 281.920 to 281.936.","path":["KRS Chapter 281"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=56538","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:53:34Z","sha256":"574e147c9a2cfd475f7b4eb5d8dbc6d2317d09643f918869e6c8808373dd5927","source_id":"us-ky","stale":false,"prev":"us-ky/krs-281.936","next":"us-ky/krs-281.999"},"notice":"GroundRules: Original legal text.
