{"data":{"id":"us-ky/krs-281a.130","jurisdiction":"us-ky","citation":"KRS 281A.130","heading":"Requirements for issuance of license.","body":"(1) A person shall not be issued a commercial driver's license unless that person:\n(a) Is a resident of this state;\n(b) Holds a valid operator's license;\n(c) Has complied with the provisions of KRS 281A.300;\n(d) Except as provided in KRS 281A.165, has passed t he knowledge and skills\ntests for driving a commercial motor vehicle which comply with minimum\nfederal standards established by federal regulation enumerated in 49 C.F.R. pt.\n383, as adopted by the cabinet; and\n(e) Has satisfied all other safety requiremen ts including those requirements\nimposed by state law or federal regulation. The tests shall be prescribed and\nconducted as set forth in KRS 281A.160.\n(2) A commercial driver's license or commercial learner's permit shall not be issued to\na person while the person is subject to a disqualification from driving a commercial\nmotor vehicle or while the person's driver's license or driving privilege is\nsuspended, revoked, or canceled in any state or jurisdiction.\n(3) A commercial driver's license shall not be iss ued to a person who has a commercial\ndriver's license issued by any other state unless the person first surrenders all such\nlicenses, which shall be returned to the issuing jurisdiction for cancellation.\n(4) To ensure that an applicant for a commercial dri ver's license or commercial\nlearner's permit complies with the requirements of subsections (2) and (3) of this\nsection, the Transportation Cabinet shall verify through the commercial driver's\nlicense information system and national driver register that the  person applying for\na Kentucky CDL does not currently have his or her operator's license or driving\nprivilege suspended or revoked in another licensing jurisdiction. If the person's\noperator's license or driving privilege is currently suspended or revoked  in another\nlicensing jurisdiction, the Transportation Cabinet shall not issue the person a\nKentucky CDL until the person resolves the matter in the other licensing\njurisdiction and complies with the provisions of this chapter and KRS Chapter 186.","path":["KRS Chapter 281A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=55036","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:53:35Z","sha256":"f0c1f2b735a623cd9d60b0cfccbca911495bf6403c9ccda587cbddc5bdf32dad","source_id":"us-ky","stale":false,"prev":"us-ky/krs-281a.120","next":"us-ky/krs-281a.140"},"notice":"GroundRules: Original legal text.
