{"data":{"id":"us-ky/krs-281a.165","jurisdiction":"us-ky","citation":"KRS 281A.165","heading":"Waiver of knowledge and skills tests for military personnel.","body":"(1) The cabinet may waive the written knowledge test, the driving skills test, or both,\nfor an applicant on active or reserve military service, or who is a member of the\nNational Guard, or within one (1) year of separation of service, who:\n(a) Is currently licensed;\n(b) Has experience driving a vehicle in the military that would require a\ncommercial driver's license to operate as a civilian;\n(c) Has a good driving record;\n(d) Certifies and provides verification that, during the two (2) year period\nimmediately prior to applying for a commercial driver's license, the applicant:\n1. Drove a motor vehicle in the military that was representative of the\ncommercial driver's license class for which he or she is applying;\n2. Has not had his or her operator's license or commercial driver's license\nsuspended, revoked, or canceled, or been disqualified from operating a\ncommercial motor vehicle;\n3. Has not been convicted of any of the disqualifyi ng offenses in 49 C.F.R.\nsec. 383.51(b) while operating a commercial motor vehicle, or of any\noffense in a noncommercial vehicle that would be disqualifying under\n49 C.F.R. sec. 383.51(b) if committed in a commercial motor vehicle;\n4. Has not been convicted of more than one (1) serious traffic violation, as\ndefined in 49 C.F.R. sec. 383.5, while operating any type of motor\nvehicle;\n5. Has not been convicted of any violation of military, state, or local law\nrelating to motor vehicle traf fic control, other than a parking violation,\narising in connection with a traffic accident, and has no record of being\nat fault in an accident while driving a vehicle in the military that would\nrequire a commercial driver's license to operate as a civilian;\n6. Has not been convicted of any motor vehicle traffic violation that\nresulted in an accident; and\n7. Is or was regularly employed in a position in the Armed Forces of the\nUnited States requiring operation of a commercial motor vehicle of the\ngroup the a pplicant seeks to drive, and provides evidence of that\nemployment in accordance with subsection (4) of this section; and\n(e) If applying for a license endorsement, provides the verification for a testing\nwaiver required under 49 C.F.R. sec. 838.77(c).\n(2) The written knowledge and skills test waiver process described in subsection (1) of\nthis section shall be completed, and the commercial driver's license issued, within\none (1) year of separation of service.\n(3) Military personnel who obtain the written kno wledge and skills test waiver under\nthis section shall be required to pay the application fee as prescribed by KRS\n281A.150, but shall not be charged the skills -testing fee as prescribed by KRS\n281A.160.\n(4) The cabinet shall promulgate administrative regu lations in accordance with KRS\nChapter 13A that establish an application form for waiver of the written knowledge\nand skills test by military personnel. As part of the application process, the\napplicant shall be required to provide:\n(a) A copy of the appli cant's DD -214 form showing the applicant's military\noccupational specialty; and\n(b) A signed statement by the applicant's commanding officer or transportation\nofficer, on a form provided by the cabinet, attesting to the fact that the\napplicant meets the requirements of this section.","path":["KRS Chapter 281A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=55031","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:53:35Z","sha256":"148ceccbe31658c636e413a251d5c840bd9cab3547b660321204d1773c5c9475","source_id":"us-ky","stale":false,"prev":"us-ky/krs-281a.160","next":"us-ky/krs-281a.170"},"notice":"GroundRules: Original legal text.
