{"data":{"id":"us-ky/krs-281a.210","jurisdiction":"us-ky","citation":"KRS 281A.210","heading":"Operating commercial vehicle while under the influence of alcohol or","body":"other controlled substance.\n(1) Notwithstanding any other provision of this chapter, a person shall not drive a\ncommercial motor vehicle within this state while having any measurabl e or\ndetectable amount of alcohol or other controlled substances in his system.\n(2) A person who drives a commercial motor vehicle within this state while having any\ndetectable amount of alcohol or controlled substance in his system or who refuses to\nsubmit to the test required in KRS 281A.220, shall be placed out of service for\ntwenty-four (24) hours.\n(3) A person who drives a commercial motor vehicle within this state with an alcohol\nconcentration of four hundredths (0.04) or more shall be deemed to be op erating a\nvehicle under the influence.\n(4) A person who drives a commercial motor vehicle within this state with an alcohol\nconcentration of four hundredths (0.04) or more, or who refused to submit to the\ntest required in KRS 281A.220, in addition to any o ther sanctions that may be\nimposed under this chapter shall be disqualified from driving a commercial motor\nvehicle under KRS 281A.190.","path":["KRS Chapter 281A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=14482","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:53:35Z","sha256":"a96001f5670af710125d3d8a1829ff8af251bfcacb20de0e662957962f0ba42b","source_id":"us-ky","stale":false,"prev":"us-ky/krs-281a.205","next":"us-ky/krs-281a.2102"},"notice":"GroundRules: Original legal text.
