{"data":{"id":"us-ky/krs-281a.290","jurisdiction":"us-ky","citation":"KRS 281A.290","heading":"Prohibition against termination of certain Transportation Cabinet","body":"employees for failure to hold commercial driver's license -- Exception --\nRequirement for employment.\n(1) The Transportation Cabinet shall not terminate the services of any employee in  a\njob classification which requires a valid commercial driver's license if:\n(a) The employee has never held an operator's license;\n(b) The employee is not eligible for a medical waiver to operate a commercial\nvehicle;\n(c) The employee's driving record as of March 31, 1992, precludes the issuance of\na commercial driver's license;\n(d) The employee's job description, as of April 1, 1992, does not require a\ncommercial driver's license;\n(e) The employee retires by December 31, 1992.\n(2) The Transportation Cabinet may terminate the employment of any employee whose\njob classification requires a commercial driver's license as of April 1, 1992, if the\nemployee holds a valid Kentucky driver's license, but has failed to apply for a\ncommercial driver's license and refuses to make an effort to take the necessary tests\nto obtain a commercial driver's license.\n(3) The Transportation Cabinet shall not require a person to possess a commercial\ndriver's license at the time of employment, but any employee who is required to\nobtain a commercial driver's license as a requirement for a job classification shall\nobtain the license prior to the expiration of the employee's six (6) month\nprobationary period.","path":["KRS Chapter 281A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=14491","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:53:35Z","sha256":"bf4adbec818869b97f56ed70efb4956c05091ddf774c194f766ecfbb80cab478","source_id":"us-ky","stale":false,"prev":"us-ky/krs-281a.280","next":"us-ky/krs-281a.300"},"notice":"GroundRules: Original legal text.
