{"data":{"id":"us-ky/krs-281a.300","jurisdiction":"us-ky","citation":"KRS 281A.300","heading":"Criminal history background check for commercial driver's licenses and","body":"permits -- Administrative regulations -- Fees.\n(1) (a) Any person initially applying for, or renewing, a Kentucky CDL or CLP shall\nbe required to undergo a state and nati onal criminal history background check\nof state and federal wanted or \"hot file\" records conducted by the State Police.\n(b) All initial and renewal application forms for a Kentucky CDL or CLP shall\nconspicuously state the following: \"STATE LAW REQUIRES A S TATE\nAND NATIONAL CRIMINAL HISTORY BACKGROUND CHECK AS A\nCONDITION OF APPLYING FOR A KENTUCKY CDL. ANY PERSON\nWHO REFUSES TO SUBMIT TO A CRIMINAL HISTORY\nBACKGROUND CHECK SHALL NOT BE ELIGIBLE TO APPLY FOR,\nOR BE ISSUED, A KENTUCKY CDL.\"\n(2) The results of  the state and national criminal history background checks shall be\nsent to the cabinet for review within seventy -two (72) hours. An applicant for a\nCLP may enroll in a commercial driver training program under the Kentucky\nCommunity and Technical College S ystem or a proprietary school licensed under\nKRS Chapter 165A, and may be issued a CLP upon enrollment, however the status\nof the applicant retaining the CLP shall not be determined until the results of the\nbackground checks are made available to the cabin et. The cabinet shall inform an\napplicant, based upon the criminal history background check, of the applicant's\neligibility to be issued a CLP or CDL. The cabinet shall promulgate administrative\nregulations in accordance with KRS Chapter 13A to specify con ditions that will\ncause a person to be denied a CLP or CDL based upon the person's criminal history\nbackground check.\n(3) Any fee charged by the State Police to conduct a criminal history background check\nshall be paid by the applicant and shall not be ref undable. Any fee charged to\nconduct a criminal history background check shall be an amount not greater than\nthe actual cost of processing the request and conducting the search.\n(4) The criminal history background checks required by this section shall be in addition\nto any type of background check that may be required by federal statute, rule,\nregulation, or order.","path":["KRS Chapter 281A"],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=55039","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:53:35Z","sha256":"0e94cb6b0cf4f6ff6adfbf07224d44fd8cb9e29630eb4939e0af66e1883d5404","source_id":"us-ky","stale":false,"prev":"us-ky/krs-281a.290","next":"us-ky/krs-281a.310"},"notice":"GroundRules: Original legal text.
