{"data":{"id":"us-ky/krs-286.11-033","jurisdiction":"us-ky","citation":"KRS 286.11-033","heading":"Confidentiality of data submitted to commissioner.","body":"(1) Documents, materials, reports, or other information in the possession or control of\nthe commissioner that is provided according to this subtitle shall be confidential by\nlaw and privileged, and shall not be subject to the Kentucky Open Records Act,\nKRS 61. 870 to 61.884. These documents, materials, reports, or other information\nshall not be subject to subpoena, and shall not be subject to discovery or admissible\nin evidence in any civil action, unless, after notice to the commissioner and a\nhearing, a court of competent jurisdiction determines that the commissioner would\nnot be prejudiced. However, the commissioner may use the documents, materials,\nreports, or other information in the furtherance of any regulatory or legal action\nbrought as a part of the commissioner's official duties.\n(2) Neither the commissioner nor any person who received documents, materials,\nreports, or other information while acting under the authority of the commissioner\nshall be permitted or required to testify in any civil action conc erning any\nconfidential documents, materials, reports, or information subject to subsection (1)\nof this section.\n(3) In order to assist in the performance of the commissioner's duties, the\ncommissioner:\n(a) May share documents, materials, reports, or other  information, including the\nconfidential and privileged documents, materials, reports, or information\nsubject to subsections (1) and (2) of this section, with other state, federal, and\ninternational regulatory agencies, with the Money Transmitter Regulator s\nAssociation, its affiliates or subsidiaries, and with local, state, federal, and\ninternational law enforcement authorities, if the recipient agrees to maintain\nthe confidentiality and privileged status of the documents, materials, reports,\nor other information;\n(b) May receive documents, materials, reports, or other information, including\notherwise confidential and privileged documents, materials, reports, or\ninformation from the Money Transmitter Regulators Association, its affiliates\nor subsidiaries, an d from regulatory and law enforcement officials of other\nforeign or domestic jurisdictions, and shall maintain as confidential and\nprivileged any documents, materials, reports, or information received with\nnotice or the understanding that they are confiden tial and privileged under the\nlaws of the jurisdiction that is the source of the documents, materials, reports,\nor information;\n(c) May enter into agreements governing the sharing and use of information,\nincluding the furtherance of any regulatory or legal  action brought as part of\nthe recipient's official duties;\n(d) May disclose to the public a list of persons licensed under this subtitle or the\naggregate financial data concerning those licensees; and,\n(e) May disclose to the public any order issued under this subtitle that is the result\nof an administrative or legal action against a licensee, agent of a licensee,\nresponsible individual, key shareholder, executive officer, or director.\n(4) No waiver of any applicable privilege or claim of confidentiality i n the documents,\nmaterials, reports, or information shall occur as a result of disclosure to the\ncommissioner under this subsection or as a result of sharing as authorized in\nsubsection (3) of this section.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=14960","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:57:15Z","sha256":"5120b2aed3c88d5bf2bcbea9e1a9f1182f95ad29d403c8e03f20f43eeb327258","source_id":"us-ky","stale":false,"prev":"us-ky/krs-286.11-032","next":"us-ky/krs-286.11-035"},"notice":"GroundRules: Original legal text.
