{"data":{"id":"us-ky/krs-286.12-140","jurisdiction":"us-ky","citation":"KRS 286.12-140","heading":"Civil penalties and other remedies.","body":"(1) (a) In addition to any other remedies, penalties, or damages available under\ncommon law or statute, the commissioner may impose a civil penalty based on\nthe following:\n1. Repeat violations of this subtitle, any administrative regulation\npromulgated under this subtitle, or any order issued by the commissioner\nunder this subtitle; or\n2. A pattern or practice of a licensee that results in a violation of this\nsubtitle, any administrative regulation promulgated under this subtitle, or\nany order issued by the commissioner under this subtitle.\n(b) A civil penalty imposed under this subsection shall be not less than one\nthousand dollars ($1,000) and not more than twenty -five thousand dollars\n($25,000) per violation per day for each day that the violation is outstanding.\n(2) In addition to any civil penalty imposed under subsection (1) of this section, the\ncommissioner may:\n(a) Assess costs and expenses for the examination, investigation, and prosecution\nof the matter, including reasonable attorney fees and costs; and\n(b) When a violation applicable to borrowers with a disability, military borrowers,\nolder borrowers, or borrowers working in public service results in financial\nharm, impose a civil penalty not to exceed twenty thousand dollars ($20,000)\nper violation per day for each day the violation is outstanding.\n(3) The commissioner may order restitution, refund, recovery of expenses, or direct\nother affirmative action as the commissioner deems necessary against any person\nwho violates any order issued by the commissione r or any provision of, or\nadministrative regulation promulgated under, this subtitle.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=52740","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:57:16Z","sha256":"6d85733e02d0a7e3d510d6527408bd656d4623521ad993128d3011d1440d1db2","source_id":"us-ky","stale":false,"prev":"us-ky/krs-286.12-135","next":"us-ky/krs-286.12-150"},"notice":"GroundRules: Original legal text.
