(Effective April","body":"30, 2027)\n(1) (a) A person shall not engage in virtual currency kiosk business in this state\nwithout:\n1. A license; and\n2. First obtaining, for each:\na. Agent, the writt en approval of the commissioner to designate the\nagent to engage in virtual currency kiosk business in this state on\nbehalf of the person; and\nb. Location at which the person, or an agent of the person, engages in\nvirtual currency kiosk business in this state:\ni. Any license, permit, registration, or other authorization\nrequired for the person, agent, or location under any\napplicable local ordinance, resolution, or regulation; and\nii. The written approval of the commissioner to do business at\nthe location, as provided in KRS 286.13-045.\n(b) Except as provided in paragraph (c) of this subsection, a person shall be\ndeemed to be engaged in virtual currency kiosk business in this state if t he\nperson:\n1. Owns, operates, solicits, markets, or advertises a virtual currency kiosk\nlocated in this state; or\n2. Engages in, or holds out as being able to engage in, a virtual currency\nkiosk transaction with or on behalf of any virtual currency kiosk user.\n(c) A person shall not be deemed to be engaged in virtual currency kiosk business\nin this state solely because the person leases space to, or otherwise contracts\nfor or allows, a virtual currency kiosk operator to locate a virtual currency\nkiosk at a store or locale in this state.\n(2) A license shall:\n(a) Be valid unless it is:\n1. Revoked or suspended by the commissioner;\n2. Surrendered by the licensee; or\n3. Expired;\n(b) Except as provided in KRS 286.13-065, not be transferred or assigned; and\n(c) Expire on December 31 of the year in which it is issued, unless renewed or\nreinstated in accordance with KRS 286.13-060.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=58280","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:57:16Z","sha256":"319568f2d0ab99b134a1ecd8f7ac0a86476a87648a4f7ad2e4a170a118ae40c0","source_id":"us-ky","stale":false,"prev":"us-ky/krs-286.13-020","next":"us-ky/krs-286.13-030"},"notice":"GroundRules: Original legal text.
