(Effective April 30, 2027)\n(1) As used in this section, \"registry\" means the S tate Regulatory Registry, LLC, or its\nsuccessor organization.\n(2) When an application, report, or approval request is required to be filed with the\ncommissioner under this subtitle, the commissioner may require that the filing,\nincluding any applicable fees and supporting documentation, be submitted to:\n(a) The registry or its successor organization;\n(b) The registry's parent, affiliate, or operating subsidiary; or\n(c) Other agencies or authorities as part of a nationwide licensing system;\nwhich may act as an agent for receiving, requesting, and distributing information to\nand from any source directed by the commissioner.\n(3) The commissioner:\n(a) May report violations of this subtitle, enforcement actions, and other relevant\ninformation that the commission er deems necessary to carry out the purpose\nof this section to the registry or its affiliated entities; and\n(b) Shall establish a process whereby licensees may challenge information\nentered into the registry by the commissioner.\n(4) The commissioner shall annually request:\n(a) Audited financial reports, including inquiring as to the budget and fees\ncollected, both proposed and actual, from the registry; and\n(b) Any nonconfidential protocols or reports for the security and safeguarding of\npersonal information maintained by the registry, including inquiring as to:\n1. Whether the system has implemented and complied with the data\nsecurity guidelines set forth in the Gramm-Leach-Bliley Act, 15 U.S.C.\nsec. 6801;\n2. The results of any nonconfidential periodic data protection audits that\nthe system may conduct; and\n3. Whether any security breaches have occurred resulting in the substantial\nlikelihood that personal information may be misused or stolen.\n(5) The commissioner may establish relationships and contracts with other\ngovernmental agencies or entities affiliated with the registry that the commissioner\ndeems necessary to carry out this section.\n(6) For purposes of thi s section, the commissioner may use other governmental\nagencies or the registry or its affiliated entities as an agent for requesting\ninformation from, and distributing information to, the United States Department of\nJustice or other governmental agencies.","path":[],"source_url":"https://apps.legislature.ky.gov/law/statutes/statute.aspx?id=58281","current_through":"Includes enactments through the 2026 Regular Session","vintage":"09/05/2026","retrieved_at":"2026-09-05T20:57:16Z","sha256":"50aff9fede459ea1546459db160a7c6cf0f27925e16e6b0a73d07bfc064d91d9","source_id":"us-ky","stale":false,"prev":"us-ky/krs-286.13-025","next":"us-ky/krs-286.13-035"},"notice":"GroundRules: Original legal text.
